UNDER DEED OF TRUST
Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on
May 14, 2025 at 11:00 a.m.
offer for sale certain property described in that certain deed
of trust executed by HALL OF FAME BUILDERS, LLC, a West Virginia limited liability company, to Jennifer L. Morgan and Matthew E. Osborne, as Trustees, which deed of trust is dated the 5th day of October, 2023, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 632, at Page 456; and given to secure Citizens Bank of West Virginia the payment of a note therein described. The premises subject to the above-described deed of trust, which premises will be sold at the above stated public auction are those certain parcels of real estate situate in the Townsite of Norton in Roaring Creek District of Randolph County and State of West Virginia, together with any and all appurtenances and improvements situate thereon and thereunto belong, and more particularly bounded and described as follows:
FIRST PARCEL: The surface only of Lot No. 9 of Block No. 3 of the Townsite of Norton, BEGINNING at point on the east side of Coalton Avenue, corner of Lots No. 8 and 9 and running thence with the division line between them S 77 degrees E 125 feet to a stake or point on the west side of Bridge Street; thence with Bridge Street S 13 degrees W 50 feet to a stake or point; corner of Lots Nos 9 and 10%; thence with the division line between them N 77 degrees W about 100 feet to a stake or point on the east side of Coalton Avenue; thence in a northwesterly direction with a curve to the left with a radius of 934.33 for a distance of about 67 feet to the place of beginning, as shown on the Land Books of Randolph County on Tax Map 1 as Parcel No. 0021 – Roaring Creek District.
SECOND PARCEL: The surface only of Lot No. 10 of Block No. 3, bounded on the North for about 100 feet by Lot No. 9, on the east for about 283 feet by Bridge Street which runs about S 13 degrees W and at right angles to the north boundary of said lot, on the south for about 30 feet by Bridge Street, and on the west for about 300 feet on a slight inward curve by Coalton Avenue, which runs about north and south, as shown on the Land Books of Randolph County on Tax Map 1 as Parcel No. 0022 – Roaring Creek District. And being the same real estate conveyed by Donnie Mersing to Hall of Fame Builders, LLC, by virtue of a Deed dated October 5, 2023, of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 635, at Page 608.
This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.
The above-described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except 2 those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.
TERMS OF SALE: Cash in hand on day of sale, or ten percent (10% down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real
estate “AS IS”.
The undersigned Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of
sale and any continuance thereof.
