NOTICE OF SALE OF
REAL ESTATE
Notice is hereby given that in accordance with an Order of the Circuit Court of Wood County, West Virginia, in the above styled civil action, C. Blaine Myers, Special Commissioner, shall offer for sale at the front door of the Wood County Courthouse, One Court Square, Third and Market Streets, Parkersburg, Wood County, West Virginia, on June 9, 2025 at 10:00 am certain real property located in the City of Parkersburg, Wood County, West Virginia, Map 22, Parcel 43 and more particularly described as follows:
FIRST TRACT: BEING all of Lots Nos. Seven (7), Eight (8) and Nine (9) in Block No. 7, of Dudley’s Second Addition, to the City of Parkersburg, Wood County, West Virginia, as laid down, designated and described upon a plat of said Addition, which said plat is of record in the County Court Clerk’s Office of Wood County, West Virginia in Deed Book No. 78, at Page 81, to which said plat, so of record, reference is now here made for a full and complete description of said lots, tracts or parcels of land, and being the same lots, tracts or parcels of land conveyed to the said parties of the first part on the 10th day of April, 1952, by D. L. Maxwell and Mary K. Maxwell, his wife, which deed of conveyance is of record in the said County Court Clerk’s office of Wood County, West Virginia, in Deed Book No. 353, at Page 498, to which deed of conveyance reference is now here made for a further description of said lots, tracts or parcels of land.
SECOND TRACT: The Western one-half of Lot No. 6, Block No. 7 of Dudley’s Second Addition to the City of Parkersburg, Wood County, West Virginia, as laid down, designated and described upon a plat of said addition, which said plat is of record in said County Court Clerk’s office of Wood County, West Virginia in, Deed Book No. 78, at Page 81, to which plat reference is now here made for a full and complete description of said one-half lot, tract or parcel of land.
BEING the same property acquired by Ronald Friend by Deeds of record in the Office of the Clerk of the County Commission of Wood County, West Virginia in Deed Book 1218 at Page 399 and Deed Book 1069 at Page 27, respectively. The physical address of the property is 1061 39th Street, Parkersburg, Wood County, West Virginia.
Said property shall be offered for sale to the highest bidder, subject to confirmation by Order of the Circuit Court of Wood County, West Virginia. Terms of sale shall be 10% deposit on day of sale, with the balance to be paid within a reasonable time as determined by the Special Commissioner and Purchaser, and as approved by the Court. In the event the Purchaser fails to pay the balance of the purchase price within such reasonable time, the 10% deposit shall be forfeited and retained by the Special Commissioner towards the fees and expenses associated with sale.
The above described real estate will be conveyed with no covenants of warranty and subject to any and all easements, rights-of-way, conditions, covenants, restrictions, exceptions, reservations, leases, real estate taxes and other encumbrances which may be a matter of record in the Office of the Clerk of the County Commission of Wood County, West Virginia or visible upon the ground.
Prospective purchasers are hereby notified that the above described real property is presently owner occupied, and the Special Commissioner shall have no obligation or responsibility to cause the occupant to be removed from said property. All matters relating to the possession and occupancy of said real property shall be the sole responsibility of the purchaser.
In the event a federal tax lien is filed encumbering the property described above, any sale of said property is subject to the right of redemption pursuant to 28USC §2410 or any other applicable law.
