TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated April 8, 2004, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 3120, at Page 743, Barry S Jackson did convey unto Nelson M. Michael, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by NewRez LLC d/b/a Shellpoint Mortgage Servicing to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on September 25, 2025 at 1:00 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 10 – Chas N District, Kanawha County, West Virginia, and more particularly described as follows: All that certain parcel of land situated on Oak Ridge, between Wilson and Black Hawk Hollows, in Charleston District, County of Kanawha, State of West Virginia, being bounded and described as follows: Beginning at an iron pipe in the southerly line of the Charles Hess Road, common corner of the lot of land here conveyed, and to a lot containing 0.20 acres, more or less, conveyed by Charles Hess and Edith Hess to George C. McLaughlin and Virginia Taylor McLaughlin, his wife, thence leaving said Charles Hess Road, and with the division line between the lot hereby conveyed and that conveyed to said McLaughlin, S 30 11′ E 124.26 feet to an iron pipe in the line between the property of Charles Hess and the Riverview Addition; thence with said Riverview Addition, S 63 13′ W 114.06 feet to an iron pipe; thence leaving said Riverview Addition and with the division line between the property of Charles Hess and land owned by Donald L. Cork, N 58 12′ W 154.05 feet to an iron pin at the southeast corner of a cemetery lot; thence with one line of the cemetery lot N 25 13′ E 61.24 feet to an iron pipe; thence leaving the cemetery lot, N 47 37′ E 83.61feet to an iron pipe in the southerly line of the Charles Hess Road; thence with the southerly line of said Charles Hess Road, S 57 32′ E 73.03 feet to an iron pipe; and continuing with same, S 76 36′ E 21.45 feet to the beginning, containing 0.59 acres, more or less as shown upon a map or plat the same recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1243, at page 27. Tax ID: Map 73 Parcel 22 Tax Id 22812 The party of the first part herein is further granted the right to use that certain road right-of-way known a Hess Road, as established in that certain deed from Edith G. Hess, Widow, unto Charles R. Carton, Sr., et al, dated August 30, 1970, and recorded in said Clerk’s office in Deed Book 1611, at page 622. This conveyance is made subject to any and all covenants, restrictions, easements, and reservations which may be a matter of record in the Clerk’s Office aforesaid and running with the land. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 728 Hess Dr, Charleston, WV 25311. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
