The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated August 14, 2009, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed of Trust Book 846, at Page 271, Timothy L. Williams did convey unto Carl H. Cather, III, Esq., Spillman, Thomas & Battle, PLLC, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse, in Fayetteville, West Virginia, on
November 6, 2025, at 1:32 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Valley District, Fayette County, West Virginia, and more particularly described as follows:
LOT NO. 80, Section 1, as shown on a map filed and of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Map Book 14, at jpages 5 and 6, and designated "Map Showing Boomer Addition, Section 1, Ellectro Metallurgical Company, Falls District, Fayette County, West Virginia, EBL-101, dated August 28, 1966".
And being the same property conveyed unto the party of the first part herein by deed of Terry M. White, Attorney in Fact for Christine Moshino (aka Mashino), dated the 14the day of August, 2009, to be recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, simultaneously with this instrument.
This instrument is made subject to all lawful restriction, reservation, covenants and conditions made and contained in prior deeds in the chain of title to the above described real estate, and more particularly those set forth in Deed Book 198, at page 427.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 80 B. Street, Boomer, WV 25031.
AND BEING the same real estate which was conveyed to Timothy L. Williams, by Deed dated August 14, 2009, from Terry M. White, Attorney in Fact for Christine Moshino (being the same person as Christine Mashino), and recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 651, at Page 230.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
