Pursuant to the authority vested in the undersigned Campbell Woods, PLLC, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Fayette, West Virginia, and by Deed of Trust dated October 27, 2009, executed by Christopher B. Frost to BB&T Collateral Service Corporation, Trustee, which deed of trust is of record in the Office of the Clerk of Fayette County, West Virginia, in Trust Deed Book 849 at Page 729, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on October 7, 2025 at 11:30 a.m. to the highest bidder at the front door of the Courthouse of said County of Fayette, in Fayetteville, West Virginia, which real estate is more completely described as follows:
The property situate off Sanger Road, Plateau District, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit:
BEGINNING at an iron pipe (set) on the common line of Glen Harvey Land Company (Deed Book 599/Page 462), and Kenneth Burgess (Deed Book 251/Page 42) of which this is a part, said iron pipe bears S 26° 00' E – 414.62' from an iron pipe (found) at the common corner of Glen Harvey Land Company and Silas Palmer (Deed Book 111/Page 407) which iron pipe is on the southern right-of-way of WV Secondary Route 19/5 (Sanger Road); thence leaving the common line of said Glen Harvey Land Company and Kenneth Burgess for the following four calls, (1) N 63° 43' E – 218.98' to an iron pipe (set), (2) S 55° 24' E – 332.93' to an iron pipe (set), (3) S 49° 24' W – 395.18' to an iron pipe (set) on the common line of said Glen Harvey Land Company and Kenneth Burgess; (4) N 26° 00' W – 388.59' to the point of beginning, and containing 2.45 acres more or less.
The following described non-exclusive easement for ingress and egress, situate off Sanger Road, Plateau District, Fayette County, West Virginia, and being more particularly described as follows:
BEGINNING at a point in the centerline of a 30 wide right-of-way, said point bears S11° 05' W – 39.43' from an iron pipe (found) at the common corner of Glen Harvey Land Co. (Deed Book 599/Page 462), and Silas Palmer (Deed Book 111/Page 407); thence with the centerline of said right-of-way for the following three calls (1) S 28° 05' E – 239.56' to a point, (2) S 44° 28' E – 26.46â to a point, (3) S 59° 00' E – 140.96' to a point on line of a 2.45 acre parcel of land to be conveyed unto Chris Frost, said point bears N 63° 43' E – 70.03' from an iron pipe (set) at the northwestern corner of Chris Frosts 2.45 acre parcel.
TERMS OF SALE
1.Cash in hand paid on the day of sale.
2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever.
3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code § 11-22-2.
4. The subject property will be sold in "AS IS" condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed.
5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time without further notice by announcement at the time and place of the sale described above.
7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid.
8. Such other terms as may be announced at the time of Sale.
