NOTICE OF TRUSTEE’S SALE
Under authority of that certain Deed of Trust dated June 27, 2011, from Wesley O. Summerfield and Jody L. Summerfield to Gregory R. Tingler, Trustee , of record in the office of the Clerk of the County Commission of Randolph County, West Virginia in Trust Deed Book No. 488, at page 698, securing a promissory note in the principal amount of $69,222.56, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Substitute Trustee will offer for sale at the front door of the Randolph County Courthouse in Elkins, West Virginia on February 24, 2026 at 12:00 p.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, that certain tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on the Files Creek Road (WV Secondary Route 37/8), on the north side thereof, 1.3 miles east of Beverly, West Virginia, on the waters of Files Creek of the Tygart Valley River, Beverly District, Randolph County, West Virginia, more particularly bounded and described as follows:
Beginning at a 5 inch by 6 inch by 12 inch high above ground rectangular shaped stone, found, at a wire fence corner, a corner Michael Lee Wyatt (Deed Book 346 at page 58) and a corner to Marsha Lee L. Yoakum (Deed Book 526 at page 179), thence with said Yoakum and in part along a wire fence N 59 deg 11′ E, 173.34 feet to a point in the centerline of an old road grade at a gap in said wire fence, a corner to said Yoakum, 7 feet northeast of a fence corner, set a 3/4 inch by 36 inch rebar with 2-3/4 inch diameter orange plastic cap, thence continuing with said Yoakum and with the centerline meanders of said old road grade for fifteen lines S 34 deg 18′ E, 39.99 feet to a point, thence S 16 deg 44′ E, 42.18 feet to a point, thence S 11 deg 36′ E, 98.31 feet to a point, set a 3/4 inch by 30 inch rebar with a 2-3/4 inch diameter orange plastic cap, thence S 14 deg 55′ E, 37.85 feet to a point, 6 feet right of a down apple tree and 6.4 feet left of a wire fence post, thence S 27 deg 16′ E, 29.29 feet to a point, from which a 6 inch locust bears S 71 deg 35′ W, 9.70 feet, thence S 26 deg 05′ E, 40.63 feet to a point, thence S 15* 15′ E, 43.93 feet to a point, thence S 0* 26′ E, 26.79 feet to a point, thence S 6 deg 23′ W, 24.20 feet to a point, set a 3/4 inch by 30 inch rebar with a 2-3/4 inch diameter orange plastic cap, thence S 17 deg 46′ W, 27.98 feet to a point, thence S 24 deg 34′ W, 21.32 feet to a point, thence S 37 deg 31′ W, 39.43 feet to a point, thence S 46 deg 49′ W, 38.87 feet to a point, set a 3/4 inch by 30 inch rebar with a 2-3/4 inch diameter orange plastic cap, thence S 47 deg 35′ W, 64.13 feet to a point at the center of a gate, thence S 52 deg 36′ W, 15.90 feet to a point at the intersection of the centerline of said old road grade with the northern right-of-way of the Files Creek Road, 15 feet from the centerline thereof, from which a 3/4 inch by 30 inch rebar with a 2-3/4 inch diameter orange plastic cap set, bears N 52 deg 36′ E, 6.00 feet, thence with the northern right-of-way of said Files Creek for two lines N 70 deg 51′ W, 22.20 feet to a point on the northern right-of-way of said Files Creek Road, a point on the western boundary of a 20 feet wide designated road right-of-way, from which a 3/4 inch by 30 inch rebar with a 2-3/4 inch diameter orange plastic cap set, bears N 37 deg 48′ E, 5.27 feet, and an electric pole bears N. 45 deg 25′ W, 15. 10 feet, thence N 70 deg 51′ W, 96.76 feet to a point on the northern right-of-way of said Files Creek Road, 15 feet from the centerline thereof, a corner to Jonathan D. Nitz (Deed Book 378 at page 497), from which a 3/4 inch by 36 inch rebar, with a 2-2/3 inch diameter orange plastic cap, set, on the north bank of a ditch, bears N 18 deg 20′ E, 5.05 feet and a rectangular stone with a broken top, found, bears N 67 deg 13′ W, 134.42 feet, thence with said Nitz N 18 deg 20′ E, 63.79 feet to a point, a corner in line of said Nitz and a corner to Parcel No. 2 of this division survey, set a 3/4 inch by 36 inch rebar with a 2-3/4 inch diameter orange plastic cap, thence through the parent Summerfield tract of Deed Book 543 at page 554 and with said Parcel No. 2 for three lines S 81 deg 03′ E, 128.93 feet to a point on the western boundary of said designated 20 feet wide right-of-way, set a 3/4 inch by 30 inch rebar with a 2-3/4 inch diameter orange plastic cap, thence with said right-of-way N 37 deg 48′ E, 75.20 feet to a point at the end of said right-of-way, set a 3/4 inch by 14 inch rebar with a 2-3/4 inch diameter orange plastic cap, thence N 81 deg 03′ W, 154.38 feet to a point on a hillside, a corner to said Parcel #2 of this division survey and a corner in line of Jonathan D. Nitz (Deed Book 378 at page 497), set a 3/4 inch by 36 inch rebar with a 2-3/4 inch diameter orange plastic cap, thence with said Nitz for two lines N 18 deg 20′ E, 96.57 feet to a 1/2 inch iron pipe, found, on top of a spur ridge, thence N 43 deg 54′ W, 150.85 feet to a 1/2 inch iron pipe, found at an old wire fence corner, 12 feet north of said ridge, a corner to said Nitz and a corner in line of Michael Lee Wyatt (Deed Book 346 at page 58), thence with said Wyatt N 18 deg 10′ E, 70.28 feet to the beginning, containing 1.77 acres as surveyed in April 2011 by Leon G. Mallow of Leon G. Mallow Surveying, Inc., Route 1, Box 117, Montrose, WV.
Together with a certain 2010 Clayton Manufactured Home, Serial No. CLH034944TNAB.
Being the same property conveyed from Lausinda C. Harman to Wesley O. Summerfield and Jody L. Summerfield, by Deed dated May 23, 2011, of record in the aforesaid Clerk’s office in Deed Book No. 546, at page 178.
