TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated February 1, 2010, and duly recorded in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Document No. 135132, in Book No. 552, at Page 318, David R Adkins and Melissa N Adkins did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Federal Home Loan Mortgage Corporation, as Trustee for Freddie Mac SLST 2024-1 Participation Interest Trust to foreclose thereunder, will offer for sale at public auction at the front door of the Jackson County Courthouse in Ripley, West Virginia, on June 8, 2026 at 2:00 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 04 – Ripley District District, Jackson County, West Virginia, and more particularly described as follows: All those certain lots, tracts or parcels of real estate, situate, lying and being on the waters of Grass Lick, in Ripley District, near the Village of Fairplain, Jackson County, West Virginia, more particularly bounded and described as follows: TRACT ONE: BEGINNING at an iron stake a corner to Rhodes lot at the top of steep bank; thence N. 38 deg. 45′ W. 174.5 feet to an iron stake; thence N. 3 deg. 30′ W. 200 feet to an iron stake in the Johnson line; thence with the same N. 80 deg. 45′ E. 100 feet to an iron stake corner to Johnson and Rhodes; thence with said Rhodes line S. 3 deg. 30′ E. 352 feet to the place of beginning, containing sixty-six (0.66) hundredths of an acre, more or less, a plat of which was prepared by H. D. Somerville and R. C. Hutchinson, surveyors, dated August 29, 1967. TRACT TWO: BEGINNING at an iron stake on the north side of a 20 foot wide drive where it intersects with a 16 foot wide drive being the southeast corner of said lot; thence along the edge of said 16 foot wide drive S. 86 deg. 15′ W. 150 feet to an iron stake; thence leaving said 16 foot wide drive N. 1 deg. W. 185 feet to an iron stake at the line of Eva L. Staats; thence with the line of Eva L. Staats N. 80 deg. 45′ E. 150 feet to an iron stake; thence S. 3 deg. 30′ E. 200 feet to the place of beginning, containing 29,550 square feet, more or less. There is excepted and reserved from the above described Tract Two all that certain lot, tract or parcel of real estate containing 15,728.5 square feet, more or less, as conveyed unto Gary Michael Samples and Sheila E. Samples, his wife, by Gilbert Lee Adkins and Carole Lea Adkins, his wife, by deed dated April 5, 1975, of record in the aforesaid Clerk’s office in Deed Book 220, page 678. The real estate herein described is the same real estate conveyed unto David R. Adkins and Melissa N. Adkins, husband and wife, by G. L. Adkins and Carole Lea Adkins, his wife, by deed dated December 23, 2009, not yet of record in the office of the Clerk of the County Commission of Jackson County, West Virginia, but to be recorded simultaneously herewith. There is further granted and conveyed all that certain non-exclusive easement of right of way from U. S. Route 21 to the lands herein conveyed, which said right of way is bounded and described in those certain deeds of record in Deed Book 193, page 344, and in Deed Book 211, page 502, and subject to the agreement to maintain the right of way bordering on the lands herein described, as more particularly set out and defined in the aforesaid deed. This conveyance is made subject to all oil, gas and mineral reservations as made by predecessors in the chain of title and to all valid existing rights of way and easements appearing of record. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 94 Early Lane, Ripley, WV 25271. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $7000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. Sale is also subject to buyer providing Trustee with information needed for reporting requirements required by Federal Law including FinCen requirements (31 CFR Chapter X) within 15 days from date of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
