TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated January 23, 2004, and duly recorded in the Office of the Clerk of the County Commission of Mineral County, West Virginia, in Deed of Trust Book 382, at Page 276, Gary Lynn Smith did convey unto Richard A. Pill, Esq., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Mineral County Courthouse, in Keyser, West Virginia, on July 6, 2026, at 8:00 AM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Keyser Municipal District, Mineral County, West Virginia, and more particularly described as follows: PARCEL ONE BEGINNING at a stake in the Northerly boundary line of Barnes Street at the Southeasterly corner of a lot conveyed to Ivan Mills, et ux, by deed from B.F. Price, et ux, dated January 17, 1960, and recorded in the Office of the Clerk of the County Commission of Mineral County, West Virginia, in Deed Book 92, at Page 244; and running thence with and binding upon said Barnes Street in an Easterly direction, with a portion of the front line of Lot No. 12 and a portion of the front line of Lot No. 11 of said Addition, for a distance of 30′ in all to a stake; thence at a right angle to Barnes Street, and making a division line through said Lot No. 11 and for a distance of 120′ to a stake in the line of a 20 foot alley; thence with said alley line in a Westerly direction for a distance of 30′ to a stake, corner of said Ivan Mills property; thence with said Ivan Mills property line in a Southerly direction for a distance of 120′ to the place of BEGINNING, being parts of Lots Nos. 11 and 12 as shown on the Plat of said Hetzel’s Addition to the City of Keyser. PARCEL TWO BEGINNING at a post in the alley, the division line between the land owned by Ivan Mills, et ux, and Lot No. 12 of Hetzel’s Addition to Keyser now owned by B.F. Price, et ux, and extending with the line of said alley toward Lot No. 11 a distance of 52′; thence running parallel with the division line of land owned by said Ivan Mills, et ux, and Lot No. 12 everywhere 52′ to Barnes Street; and thence running with Barnes Street toward the land now owned by said Ivan Mills, et ux, to the division corner thereof; and thence running with the division line of the lot owned by said Ivan Mills, et ux, and Lot No. 12 to the alley, the point of BEGINNING. BEING the same real estate which was conveyed to Gary Lynn Smith by Robet G. Tetrick by deed dated January 23, 2004 and to be recorded prior to the recordation of this instrument. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 488 Barnes Street, Keyser, WV 26726. AND BEING the same real estate which was conveyed to Gary Lynn Smith, by Deed dated January 23, 2004, from Robert G. Tetrick, and recorded in the Office of the Clerk of the County Commission of Mineral County, West Virginia, in Deed Book 314 at Page 588. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
