NOTICE OF SPECIAL COMMISSIONER’S SALE OF REAL
ESTATE
Pursuant to the Order Directing Partition Sale and Appointing Special Commissioner entered May 12, 2026, by the Circuit Court of Pendleton County, West Virginia, in the civil action styled Anissa E. Worthy and Cameron R. Worthy v. Adam R. Worthy, Amanda W. Dombrowski, and Caitlin R. Worthy, Civil Action No. CC-36-2026-C-4, the undersigned Special Commissioner will offer for sale at public auction, to the highest bidder, the following described real estate:
A tract or parcel of real estate, together with all improvements thereon, lying and being in Franklin District, Pendleton County, West Virginia, containing 90.70 acres, more or less, situate in an area known as “Friends Run,” and identified on the land books of Pendleton County as Tax Map 26, Parcel 34.1. The real estate is more particularly described in that certain Confirmation Deed dated December 21, 2020, of record in the Office of the Clerk of the County Commission of Pendleton County, West Virginia, in Deed Book 214, at Page 40.
DATE, TIME, AND PLACE OF SALE: Friday, July 17, 2026, at 11:00 a.m., on the front steps of the Pendleton County Courthouse, located at 100 South Main Street, Franklin, Pendleton County, West Virginia 26807.
TERMS OF SALE: The successful bidder shall pay a deposit of ten percent (10%) of the purchase price on the day of sale, by cash, certified or cashier’s check, or other immediately available funds, or such other amount or terms as the Special Commissioner finds acceptable at the time of sale, with the balance due within thirty (30) days after entry of an order confirming the sale, or within such other time as the Court may order. The deposit shall be held subject to further order of the Court.
The purchaser shall bear all costs of sale and conveyance, including without limitation deed preparation, the State of West Virginia excise tax on the privilege of transferring real estate, all recording fees and charges, and all other closing and conveyance costs. The purchaser shall further be responsible for the real estate taxes assessed against the property for the 2026 tax year in full, without proration. Real estate taxes for tax years prior to 2026, and any liens, assessments, or other charges of record affecting the real estate, shall be addressed as the Court may order, including possible payment from sale proceeds.
The real estate will be sold as-is, where-is, and with all faults, without any express or implied representation or warranty by the Court, the Special Commissioner, Plaintiffs, or Defendants as to condition, acreage, boundaries, access, marketability, title, liens, encumbrances, zoning, availability of utilities, or any other matter, except as may be stated in a deed from the Special Commissioner following confirmation by the Court. The sale conveys only the right, title, and interest of the parties to this action, subject to all easements, rights-of-way, restrictions, reservations, covenants, conditions, exceptions, leases, liens, encumbrances, matters of record, and matters that would be disclosed by an accurate survey, title examination, or physical inspection of the property.
The sale shall not be contingent upon the purchaser obtaining financing.
If the successful bidder fails to complete the purchase as required, the deposit may be forfeited and applied as the Court may direct, and the property may be resold at the risk and cost of the defaulting bidder, subject to further order of the Court.
The sale is subject to confirmation by the Circuit Court of Pendleton County, West Virginia.
Upon payment of the purchase price in full and confirmation of the sale by the Court, the Special Commissioner shall execute and deliver a deed conveying the interests of the parties to this action, subject to the terms stated herein and any further order of the Court.
