NOTICE OF TRUSTEE’S SALE

 

Under and by virtue of the authority vested in the undersigned Trustee, by that certain Deed of Trust dated June 16, 2006, executed by 1777 Inc., a Colorado Corporation, securing Blackburne & Brown Mortgage Company, Inc., of record in the aforesaid Clerk’s Office in General Lien Book 1367, at page 177, and said Deed of Trust providing that the Trustee on being required so to do by the holder of the Promissory Note secured by said Deed of Trust, should sell the hereinafter described at public auction, and default having been made in the payment of the indebtedness secured thereby and having been requested so to do, the undersigned will sell at public auction on

 

Monday, November 14, 2016, at 10:00 o’clock a.m.,

 

at the front door of the Wood County Courthouse in Parkersburg, West Virginia, that certain real estate situate in the District of Parkersburg, County of Wood, and State of­­­­ West Virginia, more particularly bounded and described as follows:

 

BEGINNING at an iron pipe set in the northerly right of way line of new U. S. Highway #50 ­ Project #APD-282-(38), said iron pin being the southwest corner of a 1.09 acre tract leased to William Seddon, et al, which lease is recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 561, page 6; thence with the said right of way line of said U. S. Route #50 with a curve to the left, having a radius of 5,238 feet, and a chord that bears N. 81õ 04’ W. 665.5 feet, a distance of 665.70 feet, more or less, to an iron pin set at State Road Commission Survey Station 295 + 27, 50 left of center line, said iron pin also being the beginning of Inter-State 77 Controlled Access right of way; thence with said controlled access right of way, the following eight courses and distances:  N. 71õ 36’ W. 98.8 feet; N. 12õ E. 80.16 feet; N. 3õ 58’ W. 153.12 feet; N. 79õ 27’ W. 241 feet; N. 35õ 03’ E. 268.99 feet; N. 4õ 52’ E. 167.79 feet; N. 49õ 46’ E. 289.8 feet; and N. 7õ 48’ E. 94.98 feet to a point in the line of Roy L. Smith property; thence leaving said I-77 right of way and with the line of Roy L. Smith S. 82õ 15’ E. 108 feet to a 40-inch black oak; thence S. 3õ 24’ W. 670.73 feet to a 20-inch white oak; thence N. 88D 30’ E. 336 feet following an old fence line to a point; thence S. 43õ 55’ E. 317 feet, more or less, to an iron pin set at the northwest corner of said Seddon lease; thence S. 14õ 10’ W. 180 feet, more or less, to the place of beginning, containing 10.17 acres, more or less, which said real estate is more particularly described on a plat prepared by Arden L. Marshall, Surveyor, dated January 5, 1970, a copy of which said plat is recorded in the aforesaid Clerk’s Office in Deed Book 570, at page 462, reference to said plat, which is hereby made, for a more particular description of the real estate herein conveyed.

This conveyance is made subject to utility rights of way of record and to a pipe line right of way heretofore granted unto Midwestern Engineering and Construction Company for the construction of a 14-inch pipe line, and to the State Road Commission of West Virginia for the re-location of said pipe line, the location of which said pipe line is shown on the plat hereinabove referred to and therein designated as âgas line.ã

There is EXCEPTED AND RESERVED from this conveyance the same right of way as excepted and reserved in previous Deeds for the purpose of ingress and egress over and across the driveways and roadways now or hereafter constructed on the real estate herein conveyed, from the access road to new U. S. Route #50 to the 1.09 acre tract of land immediately adjoining the herein described real estate on the east.

There is further EXCEPTED AND RESERVED that certain lot, tract or parcel of real estate containing 0.63 acres, conveyed to the West Virginia Department of Highways by deed dated March 13, 1973, and of record in the aforesaid Clerk’s Office in Deed Book 614, at page 425.

Being the same property conveyed to 1777 Inc., a Colorado Corporation, by Blackburne & Brown Mortgage Company, Inc., by Deed dated June 14, 2006, of record in the aforesaid Clerk’s Office in Deed Book 1098, at page 532.

 

TERMS OF SALE: Said property will be sold for cash in hand on the day of sale, or acceptable letter of credit, by auction to the highest bidder. The sale shall be further subject to the following:

 

(1) Real estate taxes delinquent, due and payable or to become due and payable;

 

(2) Any statutory lien or liens that have priority over the subject deed of trust that may affect the property;

 

(3) Any and all validly existing and continuing covenants, conditions, restrictions, reservations, easements and rights-of-way of record in the chain of title to the property or affecting title to the property;

 

(4) Such matters as could be ascertained by a current survey or physical inspection of the property;

 

(5) The property will be sold AS IS, WHERE IS, in its present condition with all faults and defects, if any, and without any warranty express or implied.

 

Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale.
