This action styled XTO Energy Inc. v. The Unknown or Missing Heirs and Beneficiaries of Mary M. Martin aka Mary Magdalene Nay Martin is brought for the purpose of authorizing the execution and delivery of a valid and present mineral lease for development of the particular minerals as described in the Verified Petition, and thereafter, should no person or entity claim ownership of the Respondents’ interest within seven (7) years following the date of the lease, for the Court to order a conveyance of the Respondents’ mineral interest pursuant to W. Va. Code § 55-12A-7, subject to the lease.
A copy of the Verified Petition can be obtained from the Circuit Clerk of Marion County, West Virginia and/or from Matthew Casto, Esq., or Tiffany M. Arbaugh, Esq., attorneys for the Petitioner, with an office located at 300 Summers Street, BB&T Square, Suite 1000, Charleston, West Virginia 25301. The Unknown or Missing Heirs and Beneficiaries of Mary M. Martin aka Mary Magdalene Nay Martin must respond to the Verified Petition and make yourself(ves) known to the Petitioner on or before March 13, 2020, or action may be taken by the Court in accordance with the law.
NOTICE IS HEREBY GIVEN, in accordance with W. Va. Code § 55-12A-5(c), that an action has been instituted in the Circuit Court of Marion County, West Virginia, bearing Civil Action No. 20-C-10 upon the Verified Petition of XTO Energy Inc., to appoint a Special Commissioner pursuant to W. Va. Code § 55-12A-4 for the purpose of leasing the oil and gas interest owned by the unknown or missing heirs and beneficiaries of Mary M. Martin aka Mary Magdalene Nay Martin, whose identities and last known addresses are unknown.
