NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned J. Patrick Jones, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Cabell West Virginia, and by Deed of Trust dated May 9, 2011, executed by Joshua Kotalic to P. Andrew Vallandingham and Samuel A. Vallandingham, Trustees, which deed of trust is of record in the Office of the Clerk of Cabell County, West Virginia, in Trust Deed Book 2447 at Page 303, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on March 3, 2021 at Noon (registration to begin at 11:30 a.m.) to the highest bidder at the east front door of the Courthouse of said County of Cabell, in Huntington, West Virginia, which real estate is more completely described as follows: All that certain lot. piece or parcel of land, situate in the City of Huntington, Cabell County, West Virginia, known and designated on a revised map of ARLINGTON, a copy of which map was filed in the Cabell County Court Clerk’s Office on 30 December, 1926 in Map Book 3, as Map 68, as THE SOUTHERLY PART (22.4 FEET FRONT) OF LOT NO. 132 AND THE NORTHERLY PART (27.6 FEET FRONT) OF LOT NO. 131, and being more particularly described as follows: BEGINNING at a point in the easterly line of Arlington Boulevard, which point is southerly with said boulevard line 22.4 feet from the corner between Lots 132 and 133, as shown on said map; thence with the said line of Arlington Boulevard, curving to the left in a southerly direction with a radius of 275 feet, passing at 22.4 feet the corner between said Lots 131 and 132 in all 50 feet; thence running thru said Lot 131, S. 65 21′ E., 142.12 feet; thence with the easterly line of said Lots 131 and 132, curving to the right in a northerly direction with a radius of 395 feet, passing at 19.57 feet the easterly corner between said Lots 131 and 132, in all 36 feet; thence running thru said Lot 132, N. 59 47′ W., 144.23 feet to the point of BEGINNING. TERMS OF SALE 1. The successful bidder (“Purchaser”) shall pay a Ten Percent (10%) nonrefundable down payment payable to the Trustee at the conclusion of the auction with balance due and payable within forty-five (45) days from the date of the Sale payable by certified check, cashier’s check or wired funds. In addition to the sales price, the Purchaser will be responsible for a ten percent (10%) “Buyer’s Premium” which will be added to the final bid amount and due at time of sale payable to Joe Pyle Auction & Real Estate Services LLC to determine final aggregate contract price. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever.
