NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned J. Patrick Jones, Trustee under that certain Deed of Trust dated April 27, 2017, executed by The Galleria, which deed of trust is of record in which deed of trust is of record in the Office of the Clerk of the County of Commission of Cabell County, West Virginia, in Trust Deed Book 2660 at Page 714, the undersigned Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Trustee, together with Joe Pyle Auction & Real Estate Services LLC, will sell the real estate described in the Deed of Trust, at a public auction on March 18, 2021 at Noon (Registration to begin at 11:30 a.m.) to the highest bidder at Suite 28, East Hills Professional Center, 5185 US Route 60, Huntington, West Virginia 25705, which real estate is more completely described as follows: A portion of Building #2 of the development known as East Hills Professional Center along US Route 60 in the Barboursville Magisterial District of Cabell County, West Virginia. Said unit being all of what is shown and described as Suite 28, having a lower vertical boundary of 617.60′ above mean sea level and an upper boundary of 633.52′ above mean sea level, said horizontal boundaries being the interior face of the finished wall or the face of the wall studding and being more particularly described as follows: From the POINT OF BEGINNING having a Northing value of 517352.0046 and an Easting value of 1591627.8283 in the project coordinate system and being the northwestern corner of said unit; Thence, N 76 44′ 55″ E for a distance of 124.94 feet to a point on a line; Thence, S 13 06′ 42″ E for a distance of 24.79 feet to a point on a line; Thence, S 76 56′ 48″ W for a distance of 115.81 feet to a point on a line; Thence, N 13 09′ 41″ W for a distance of 11.03 feet to a point on a line; Thence, S 76 44′ 31″ W for a distance of 9.08 feet to a point on a line; Thence, N 13 15′ 22″ W for a distance of 13.36 feet to the POINT OF BEGINNING, Containing 2,969 square feet, more or less, and being shown on sheet 2 of 2 of the plans titled “Plat of Survey, Condominium Survey for East Hills Professional Center, Barboursville District, Cabell County, WV'” as originally prepared by Triad Engineering, Inc. in January of 2008, with a revision date of July 23, 2013. Terms and Conditions: 1. The successful bidder (“Purchaser”) shall pay a Ten Percent (10%) nonrefundable down payment payable to the Trustee at the conclusion of the auction with balance due and payable within thirty (30) days from the date of the Sale payable by certified check, cashier’s check, or wired funds. Remote and/or online bidding may also be permitted. Please contact the auction company in advance of the sale to arrange for remote bidding. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
