NOTICE IN THE CIRCUIT COURT OF CABELL COUNTY, WEST VIRGINIA Civil Action No. 21-C-45 The Honorable Christopher D. Chiles HINSON INVESTMENTS LLC, Plaintiff, v. MAGNUS INVESTMENTS, LLC; CABELL HUNTINGTON HOSPITAL, INC.; TIMOTHY SHANE SHEETS, JR.; and ANY HEIRS AT LAW, DIVISEES, SUCCESSORS OR ASSIGNS OF TIMOTHY SHANE SHEETS, JR.; Defendants. ORDER OF PUBLICATION Plaintiff seeks to obtain free and clear of any right, title, and interest of the Defendants, to that certain piece and parcel of land situate in Cabell County, which is more fully and particularly described as follows: All that certain lot, piece or parcel of ground situate in the City Huntington, Cabell County, West Virginia, known and designated on a map of Boulevard Place, a copy of which map was recorded in the Of ce of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 114, at page 380, on the 10th day of May 1911, as Lot 148, and being more particularly described as follows: BEGINNING at a point in the southerly line of Underwood Avenue, which point is westerly 180 feet from the point of intersection of the said line of Underwood Avenue with the west line of Woodmont Road (now known as and hereafter called 19th Street); thence, with the said line of Underwood Avenue westerly 30 feet; thence, southerly and parallel to the said line of 19th Street 140 feet to a point in the north line of a 20 foot alley; thence, with said alley line easterly 30 feet; thence, northerly and parallel to the said line of 19th Street 140 feet to the point of BEGINNING. It appearing by an affidavit of record in this civil action that the Plaintiff has used due diligence to ascertain the whereabouts of the Defendants, without success, it is hereby ORDERED, that Defendants named hereinabove serve upon William G. Jones, Plaintiff’s attorney, whose address is 1002 Third Avenue, P. O. Box 1835, Huntington, West Virginia 25719, an answer or other defense to the Complaint initiating this civil action on or before the 8th day of May, 2021, otherwise judgement by default will be taken against Defendants at any time thereafter.
