NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated February 23, 2015, executed by Borrower(s), Dale J. Murphy, to First American Title Insurance Company, the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2562, at Page 533. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 165 Iroquois Trail, Ona, WV 25545. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 24, 2021, of record in the Clerk’s Office in Book 407, Page 142. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia, on the following date: 11th day of May, 2021 at 10:15 a.m. All that certain lot, piece or parcel of land, situate in Barboursville District, Cabell County, known and designated on a map of SECTION 4, INDIAN MEADOWS, a copy of which map was filed in the Cabell County Court Clerk`s Office on 30th August 1968 in Map Book 8, as Map 44, as LOT NO. 210, and being more particularly described as follows: BEGINNING at a point in the north line of Iroquois Trail at the corner between Lots 209 and 210, as shown on said map; thence with said Line of Iroquois Trail, easterly 89 feet to the corner between Lots 210 and 211; thence with the line between said lots, northerly 114.61 feet to a point in the southerly right of way line of Interstate 64; thence with said line, westerly 89.03 feet to the northerly corner between said Lots 209 and 210; thence with the line between said lots, southerly 116.84 feet to the point of BEGINNING; subject to easements for sanitary sewer in and under the easterly 5 feet and the northerly 10 feet of the described property and subject to an easement over the northerly part of the said property for gas line. And being the same property acquired by Federal National Mortgage Association by deed dated May 11, 2013 from Golden & Amos, PLLC, trustee of record in the aforesaid Clerk’s office in Deed Book 1288, at Page 107. And being the same property acquired by Dale J. Murphy by deed dated February 12, 2014 from Fannie Mae (aka Federal National Mortgage Association) of record in the aforesaid Clerk’s office in Deed Book 1297, at Page 200. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
