To: The Parkersburg High School Alumni Association, a corporation, and its officers and membership, which is or may be “composed of all of the graduates of Parkersburg High School of Parkersburg, West Virginia”, and any other unknown person or entity who would claim an interest in the Permanent Endowment Fund of The Parkersburg High School Alumni Association as created by Indenture dated September 18, 1952 by and between The Parkersburg High School Alumni Association, as Donor, and Parkersburg National Bank, as Trustee, and their heirs, devisees, successors and/or assigns, if any.
The Co-Petitioners, United Bank and Robert Stephens, have filed a PETITION TO TERMINATE TRUST in the above-entitled civil action, the object of which is to obtain an Order of Court 1) terminating the Permanent Endowment Fund of The Parkersburg High School Alumni Association, 2) authorizing and directing the Trustee to distribute the remaining principal and undistributed income of the Permanent Endowment Fund (less certain fees, costs and expenses) unto the Parkersburg Area Community Foundation for the creation of a new charitable component fund benefitting educational academic programs at Parkersburg High School and 3) fully authorizing Robert Stephens (the sole member of the Trust Committee of the Permanent Endowment Fund) to execute documents and agreements to create the aforesaid new charitable component fund, and to amend the same from time to time, provided the new charitable component fund shall at all times benefit academic educational programs at Parkersburg High School, but otherwise as he shall deem consistent with the purposes and intents of the Parkersburg High School Alumni Association.
It appearing by affidavit filed in this action that there are or may be persons or entities who would claim an interest in the Permanent Endowment Fund of The Parkersburg High School Alumni Association, whose names and whereabouts are unknown to Co-Petitioners and/or who may be non-residents of the State of West Virginia, and the Co-Petitioners having made diligent but futile efforts to locate some or all of said persons or entities; it is accordingly ORDERED that each of them do appear and serve upon William Crichton VI, Lawyer, whose address is 325 9th Street, Parkersburg, West Virginia, 26101, an answer, response or other defense to the PETITION TO TERMINATE TRUST filed in this action on or before June 4, 2021, otherwise judgment by default will be taken against them at any time thereafter.
A copy of said PETITION TO TERMINATE TRUST can be obtained from the undersigned Circuit Clerk at her office located at 2 Government Square, Parkersburg, Wood County, West Virginia, 26101.
