ORDER OF PUBLICATION
The object of the above-styled action is to acquire an approximate fifteen-foot-wide permanent easement that runs seventy-five feet in length and a related temporary construction easement on Respondents' real property by eminent domain. Petitioner has determined that acquisition of the real property interests are necessary to accomplish the purposes of constructing and improving the Danese Public Service District's water system, therefore maintaining adequate and reliable water service, through its Maplewood Water System Improvements Project (the "Project"). Specifically, an approximate fifteen-foot-wide permanent easement is necessary to construct, install, operate, maintain, repair, replace, rehabilitate, line, and/or remove a water line for use as part of Petitioner's water system in, on and under Respondents' real property and the related temporary easement is necessary for the initial construction and installation of the water line. In order to accomplish the Maplewood Water System Improvements Project, Petitioner must appropriate, acquire and use a permanent easement and temporary easement in, on, across and over the Respondents' real property designated as Parcel 24 of Tax Map 102 of the New Haven District, Fayette County, West Virginia, more particularly described in the Petition previously filed in this civil action.
If any of the Respondents claim an interest in the real estate described in the above-styled action, they or any of them must serve upon Gerald M. Titus III and Susan J. Riggs at 300 Kanawha Boulevard, East, Charleston, West Virginia 25301, an answer or other defense or statement of interest in the subject real property to the Petition filed in the above-captioned civil action on or before November 2, 2025, otherwise judgment by default will be taken against the Respondents at any time thereafter. A copy of said Petition can be obtained from the undersigned Clerk of the Circuit Court at 100 North Court Street, Fayetteville, West Virginia 25840 or by calling the said Clerk's office at 304-574-4213.
