NOTICE OF TRUSTEE’S SALE
In execution of the deed of trust, dated March 29, 2021, from Colin S. Cavell to Jeffrey D. Noble, as trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1411, at page 645, the undersigned trustee will offer for sale at public auction on June 22, 2023, at 10:00 a.m. at the North Walker Street entrance to the Mercer County Courthouse, Princeton, West Virginia, all of that certain tract or parcel of real estate, together with the improvements thereon and easements and appurtenances thereunto belonging, situate in the City of Bluefield, Mercer County, West Virginia, in the Belair addition to said City, known as Lot 1, Section 985, as shown on map of record in the Mercer County Clerk’s Office as Microfilm Plat No. 2740, and which property is more particularly bounded and described as follows:
BEGINNING at a point on the north line of Cumberland Road, which said point of beginning is marked by a concrete monument set on the north line of said Cumberland Road at a division point between the said Belair Addition and Fairfield Heights; thence with the division line between Belair Addition and Fairfield Heights, N. 29″ 03′ W. 193.04 feet to a point, the southwest corner of Lot 11, Section 985; thence with the south line of said Lot 11, N. 59″ 52′ E. 104.08 feet to a point, a common corner to Lots 1, 2, 11 and 12, all in said Section 985; thence with the west line of said Lot 2, S. 30″ 08′ E. 193.00 feet to a point in the north line of Cumberland Road, the southwest corner of said Lot 2; thence with the north line of Cumberland, S. 59″ 52′ W. 107.88 feet to the point of BEGINNING.
And being the same real estate conveyed to Colin Cavell by deed of PDX Homes, LLC, a West Virginia Limited Liability Company, dated March 24, 2021, to be recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, simultaneously herewith.
The deed of trust states that the address of the real estate is 3201 East Cumberland Road, Bluefield, West Virginia.
J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated May 17, 2023, of record in said Clerk=s Office in Trust Deed Book 1457, at page 684.
This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics, and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.
TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by a deed without any covenant or warranty, express or implied. The real estate and any improvements thereon will be sold in Aas is@ condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
