NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated November 16, 2001, executed by Borrowers, Basil H Hall and Mary V. Hall, to Jonathan Nicol, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5005, at Page 9271. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 640 Midway Road, Crab Orchard, WV 25827. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated June 8, 2023, of record in the Clerk’s Office in Book 5080, Page 3885. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

All the following described real estate situate, lying and being on the water of Crab Orchard Creek, in Town District, Raleigh County, West Virginia, bounded and described as follows, to wit: Beginning at a stake chestnut oak and dogwood pointer at edge of hard road a corner to O.P. Riffe and with said road S. 41 W. 178 ft. S. 73 W. 161 ft. to a set stone corner to John Souder and with his line N. 02 00 W. 14 ft. to a set stone on the south side of a private road and with same N. 80 W. 205 ft. to a stake corner to George Dangerfield and with his line S. 02 00 E. 75 ft. to a stake on line of hard road thence with same S. 81 W. 261 ft. to a stake thence leaving said road N. 03 23 E. 215 ft. to a stake corner to W.G. Jessup and John Souder and with latter S. 76 E. 185 ft. to a stake, thence N. 03 23 E. 235 ft. to the O.P. Riffe line, thence leaving Souder`s line and with Riffe line S. 76 E. 394 ft. to the beginning, containing 3.55/100 acres, more or less subject to the reservations contained in a deed from J.H. Fitzpatrick et al dated April the 21st, 1927, to Barney Pitzer and of record in the proper office of said Raleigh County in Deed Book 97 at page 227. Subject to all prior conveyances of coal, oil, gas, minerals, rightaways & exceptions and reserving from the operation of this conveyance the following lots or parcels heretofore conveyed: 1. That certain tract or parcel conveyed to Dinsie Dangerfield by deed of H.H. Hall and Nannie Hall, his wife, dated May 8, 1931, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 111, at Page 436, being more particularly bounded and described as follows: Beginning at a stake on the west side of hard road on the O.P. Riffe line and with same N. 76 W. 275 ft. to a set stone in the hollow below the spring thence S. 11 00 E 57ft. to a stake in the center of a spring S. 11.00 E. 220 ft. to a stake at edge of hard road and with same N. 56 E. 24ft. N 28 E. 100ft. to the beginning, containing 50/100 acres it being a part of the 3.55/100 acre tract of first lot mentioned in the above description of the said lots or parcels of land. 2. That certain tract or parcel conveyed to John Souder by deed of Ivy Pitzer and B.R. Pitzer dated June 15, 1931, of record in the aforesaid Clerk`s Office in Deed Book 117, at Page 100, being more particularly bounded and described as follows: Beginning at a stake in the center of a Spring a corner to Dinsie Dangerfield and with her line N. 11.00 W. 57 ft to a planted stone on the O.P. Riffe line and with same N. 76 W. 334 ft to a stake on said line thence leaving said line and with line of said second party S. 03 23 W. 290 ft more or less to a private road and with same as it meander South East 469 ft. to a stake or fence post near the intersection of said private road with the hard road a corner to Dinsie Dangerfield and with her line N. 57.00 W. 220 ft. more or less to the beginning containing 2.4/100 acres be it the same more or less and being a part of the land conveyed to said first parties by H.H. Hall and Nannie Hall his wife by their deed October the 17th 1930, but it is not out of the 1.3/8 acre tract which said Hall deed is of record in Raleigh County Clerk`s office in Deed Book 106 at Page 19. And being the same tract or parcel or real estate conveyed to Basil H. Hall and Mary V. Hall by deed of Ivy Pitzer, widow, dated April 29, 1981 of record in the aforesaid Clerk`s Office in Deed Book 649, at Page 433. Ivy Pitzer died February 4, 1982 dissolving her life estate

Being the same property conveyed to Basil H Hall and Mary V Hall by the Deed dated April 29, 1981 and recorded in Deed Book 649 at Page 433 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ยง 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
