NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 11, 2010, executed by Borrower, Todd Dwayne Meadows, to Richard A. Pill, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1190, at Page 211. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 227 Lakeland Dr f/k/a 208 Lakeland Park, Bluefield, WV 24701. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 2, 2024, of record in the Clerk’s Office in Book 1468, Page 167. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

“all of that certain lot or parcel of land designated as Lot 208 as shown upon `Plat Of Survey Showing Lot 208 Of Lakeland Park Subdivision Which is Located Near Glenwood Lake Approximately 5 Miles West Of Princeton In Beaver Pond District, Mercer County, West Virginia Dana Pettrey & Associates P. O. Box 641 Athens, West Virginia, Date: 7/22/80 Scale: 1” = 30`,` said Map recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 7685, and more particularly bounded and described as follows: “BEGINNING at a point in the northern line of the 40 foot wide access street shown upon said Map at an iron pin, corner of Lots 207 and 208; thence with the dividing line between said Lots 207 and 208, N. 14° 00` 00” E. 157.599 feet to a point, common corner of Lots 207, 226, 225 and 208; thence S. 51° 45` 00” E. 96.000 feet to a point, the common corner of Lots 208 and 209; thence with the dividing line between Lots 208 and 209, S. 26° 30` 00” W, 124.827 feet to a point; thence along and with the 40 foot wide access street, chord bearing N, 71° 49` 39” W, 50.828 feet to a point, and N. 76° 00` 00” W. 9.818 feet to the point of BEGINNING, containing 0.2429 of an acre, more or less.” AND BEING the same property conveyed unto Todd Dwayne Meadows by deed of Betty J. Martin, widow, dated the 14th day of May, 2010, said deed to be recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia. The lots in said subdivision are subject to a Declaration of Protective Covenants, Reservations and Restrictions as pertaining to lots in Lakeland Pak in Beaver Pond District, Mercer County, West Virginia, of record in said Clerk`s Office in Deed Book 576 at Page 44. “This conveyance is made expressly subject to all pertinent restrictions, reservations and easements or record.”

Being the same property conveyed to Todd Dwayne Meadows by the Deed dated May 14, 2010 and recorded in Deed Book 950 at Page 719 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
