NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee, Richard A. Pill, Esq., by that certain Deed of Trust dated December 18, 2007, executed by the Borrower, Connie Conrad, to Richard A. Pill, Esq., the Trustee, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Book 915, at Page 12. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1419 Hite Ave., Kingmont, WV 26578. The Borrower defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property, together with the improvements thereon and the appurtenances thereunto belonging, to the highest bidder at the front door of the Courthouse of Marion County, in Fairmont, West Virginia, on the following date:

March 25, 2024, at 4:03 p.m.

A lot or parcel of land situated on Hite Street in the Village of Kingmont, Union District, Marion County, West Virginia. Being part of lot 100 and an unnumbered lot shown on a plat of Kingmont Subdivision and recorded in Deed Book 505 at Page 241, and being lot #2 on a plat titled “Subdivision of 3 lots of John Lavigna Property”, of record in Book 1031, at Page 67, more particularly bounded and described as follows:
Beginning at a 5/8 inch I.R.(iron rod)(set) on the Right-of-Way line of Hite Street and corner to lot #1 on said Lavigna Plat; thence with part of a line with lot #1 S 41-21 E 80.00 feet to a 5/8 inch I.R.,(set) in the line of said lot #1 and corner to lot #4 on said Lavigna Plat; thence with a line of lot #4 S 48-39 W 89.76 feet to a 5/8 inch I.R., (set) in the line of lot #3 on said Lavigna Plat; thence with part of a line of lot #3 N 45-06 W 80.18 feet to a 5/8 inch I.R.,(set) on the Right-of-Way line of Hite Street and corner to lot #3; thence with said Right-of-Way line N 48-39 E 95.00 feet to the point of beginning containing 7391 square feet, more or less, as surveyed in September 1987 by Freelance Technical Services and as shown on said Lavigna Plat of record in Book 1031, at Page 67, and made a part of this description.
There is also included in this conveyance the use of a 12.00 foot Right-of-Way thru said lot #3 on Lavigna Plat for ingress and egress to said lot #2. Said Right-of-Way for lot #2 will be 12.00 feet to the Right (South) of the following described line: Beginning at a 5/8 inch I.R. in the Right-of-Way of Hite Street and corner to lots and #2 and #3 on Lavigna Plat; thence S 45-06 E 80.18 feet to a 5/8 inch I.R., corner to lots #2 and #4 and in the line of lot #3 on the Lavigna Plat.
There is reserved from this conveyance the right to leave any existing utilities that may pass thru lot #2 to any other lot in the Lavigna Subdivision in their present location. The user of said utilities have the right to enter upon said lot #2 for the purpose of maintenance and repair to said utilities. The user of said utilities will be responsible for damages & restoration of lot 2 to original condition by maintenance or repair to any such utility.
Being the same property conveyed to Connie Conrad by the Deed dated December 12, 2007 and recorded in Deed Book 1031, at Page 64, in the Office of the Clerk of the County Commission of Marion County, West Virginia.
TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
