TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 31, 2016, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Document No. 5886482, in Book No. 2611, at Page 454, Andrew Richards and Kerith R Groom did convey unto Dru A. Shope, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by MATRIX FINANCIAL SERVICES CORPORATION to foreclose thereunder, will offer for sale at public auction at the front door of the Fourth Avenue Entrance of the Cabell County Courthouse in Huntington, West Virginia, on January 10, 2023 at 3:00 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 03 – Grant District, Cabell County, West Virginia, and more particularly described as follows: The surface only of the following described real estate which is situate on the waters of Fudges Creek of Mud River, Grant District, Cabell County, West Virginia, bounded and described as follows: BEGINNING at the northwesterly most corner on a 51/3″ rebar and cap (reset) original rebar not found; thence through the lands of Jeanie D. Perry Stevens, N 76 46′ 32″ E a distance of 183.76 feet to a 51/3″ rebar and cap (found) being original Bruce Hager survey monument; thence S 01 07′ 50″ W a distance of 333.91 feet to a 51/3″ rebar and cap (found) set by Hager survey; thence N 86 42′ 11″ W a distance of 113.55 feet to a 51/3″ rebar and cap (found) set by previous survey of adjoining parcel; thence N 00 35′ 48″ E a distance of 202.26 feet to a 51/3″ rebar and cap (reset) by a 42″ maple stump original monument not found; thence N 36 19′ 44″ W a distance of 103.05 feet to the place of BEGINNING, containing by survey 0.91 acre, more or less, as shown on a map dated March 22, 2016, entitled “MAP OF SURVEY FOR ANDREW B. ESTABLISHMENT OF COMMON USE 20 FOOT WIDE RIGHT OF WAY FOR INGRESS AND EGRESS It is the desire and intention of the parties to establish a 20 foot wide easement for ingress and egress over the existing driveway for common use. Therefore, said Grantor does hereby EXCEPT AND RESERVE a 10 foot wide right of way for ingress and egress across the premises hereby conveyed for common use, described as follows: BEGINNING on a point in the northern boundary of a 0.91 acre parcel and a common point to the lands as described in Deed Book 1067, page 177; thence N 76 46′ 32″ E a distance of 10.32 feet to a 51/3″ rebar and cap (set) at the call of a 51/3″ rebar and cap (Hager Survey) but not found; thence with the abovementioned eastern boundary, S 01 07′ 50″ W a distance of 333.91 feet to a 51/3″ rebar and cap (found) by Hager Survey; thence N 86 42′ 11″ W a distance of 10.00 feet to a point in the southern boundary of aforesaid 0.91 acre parcel; thence parallel to the eastern boundary of same, N 01 07′ 50″ E a distance of 331.35 feet to the place of BEGINNING, being a part of Deed Book 1067, page 177, as recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, as shown and depicted on said survey map dated March 22, 2016. Said Grantor does further hereby GRANT and CONVEY unto the Grantees as aforesaid a 10 foot wide right of way for ingress and egress for common use, described as follows: BEGINNING on a 51/3″ rebar and cap (set) being the northeastern corner of a 0.91 acre parcel recently surveyed for the above named Perry also being at the call of a 51/3″ rebar and cap (Hager Survey) but not found; thence N 76 46’32” E a distance of 10.32 feet to a 51/3″ rebar and cap (set) by this survey being a common corner to the lands of said Perry; thence with Perry, S 01 07’50” W a distance of 336.85 feet to a 51/3″ rebar and cap (set); thence N 86 42’11” W a distance of 10.00 feet to a 51/3″ rebar and cap (found) by Hager Survey and being the southeastern corner to the aforementioned 0.91 acre parcel; thence with said eastern boundary of the same, N 01 07’50” E a distance of 333.91 feet to the place of BEGINNING, and being a part of Deed Book 1067, page 177, as recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, as shown and depicted on said survey map dated March 22, 2016. ESTABLISHMENT OF EASEMENT FOR USE OF EXISTING UTILITY LINES Said Grantor does further hereby GRANT and CONVEY unto the Grantees as aforesaid a perpetual easement for the use and maintenance of the existing water, sewer, electric, and natural gas service lines across the residue of Grantor’s lands which said utility lines serve the premises hereby conveyed. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 2471 Midland Trl, Ona, WV 25545. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and r certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
