NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Date of Publication: May 19, 2020 West Virginia Housing Development Fund 5710 MacCorkle Avenue, SE, Charleston, WV 25304 304-391-8600 These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the West Virginia Housing Development Fund (WVHDF). REQUEST FOR RELEASE OF FUNDS On or after June 5, 2020 the WVHDF will submit a request to the HUD for the release of HOME Investment Partnerships Program (HOME) funds under Title II of the Cranston Gonzalez National Affordable Housing Act of 1990, as amended, to undertake the following project: Project Title: Bentley Apartments Purpose: Bentley Apartments (Project) will involve the new construction of eleven buildings, containing a total of 24-unit low income townhome units located in Charleston, Kanawha County, WV. Location: 910 6th Street, Charleston, WV 25302; 1433, 1435 & 1439 4th Avenue, Charleston, WV 25387; 1513, 1515, 1517, 1519, 1521 & 1516 3rd Avenue, Charleston, WV 25387; 1637 7th Avenue, Charleston, WV 25387 Estimated Cost: Estimated HOME funding $534,500 and estimated total project cost $5,299,624. FINDING OF NO SIGNIFICANT IMPACT The WVHDF has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR). The ERR will be made available for review either electronically or by U.S. mail. Please submit your request by U.S. mail to WVHDF HOME Dept., 5710 MacCorkle Avenue, SE, Charleston, WV 25304 or by email to [email protected] PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the WVHDF at the above address or at [email protected]. All comments received by June 4, 2020 will be considered by the WVHDF prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. RELEASE OF FUNDS The WVHDF certifies to HUD that Erica L. Boggess in her capacity as Executive Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Bentley Apartments LP to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of fund and the WVHDF’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the WVHDF; (b) the WVHDF has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at US Department of Housing and Urban Development, Moorhead Federal Building, 1000 Liberty Avenue, Suite 1000, Pittsburgh, PA 15222-4004.
