RUTHERFORD, SHERIFF OF KANAWHA COUNTY, WEST VIRGINIA Notice is hereby given to David L. Whitlock, Janice E. Whitlock, Star USA Federal Credit Union, Unknown Persons/Owners, and Michael Y. Rutherford, Sheriff of Kanawha County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation/Right of Entry has been filed in the Circuit Court of Kanawha County, West Virginia, and is known as Civil Action No. 20-P-131, and styled Appalachian Power Company vs. David L. Whitlock, et al. Said Petition for Condemnation/Right of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate on the water of Trace Fork of Davis Creek, Jefferson District, Kanawha County, West Virginia, identified as Tax Map 18, Parcel 3.2, and recorded in Deed Book No. 1841, at page 601, in the office of the Clerk of the County Commission of Kanawha County, West Virginia, situate in the City of Charleston, and bounded and described as follows: BEGINNING at a walnut tree at the line of R. J. Murphy; thence running S 46 57 E 1023.24 feet to a pin; thence N 8 20 E 60.0 feet to a fifteen (15) foot hickory tree; thence N 49 51 E 320.23 feet to an iron pin; thence N 78 43 E 214.96 feet to an iron pin; thence N 52 51 E 315.70 feet to an iron pin and twelve (12) foot hickory in the line of Carl H. Lude; thence N 39 55 E 804.32 feet to a twelve (12) foot snag; thence N 49 59 E 159.09 feet to a thirty (30) foot cedar; thence N 11 35 W 157.94 feet to an iron pin; thence N 60 41 W 146.96 feet to an iron pin along the line of Marie K. Daugherty; thence along said line N 80 55 W 355.83 feet to an iron pin at the base of a double dogwood; thence S 29 57 W 513.16 feet to a double chestnut oak; thence along a fence line S 49 31 W 504.75 feet to a thirty-six (36) foot oak; thence N 23 28 W along an old fence line 606.85 feet to a twelve (12) foot white oak at the top of a cliff; thence S 50 23 W 919.49 feet to the place of beginning and being a 30.8 acre tract. Less conveyance of 0.412 of an acre, more or less, being Parcel “A-1”. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation/Right of Entry may be obtained from the Kanawha County Circuit Clerk’s office at 111 Court Street, Charleston, West Virginia, 25301, for the purposes of appearing and defending. The Petition for Condemnation/Right of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation/Right of Entry will occur on August 10, 2020, at 10:00 a.m., in the Circuit Court of Kanawha County, West Virginia, located at 111 Court Street, Charleston, West Virginia, 25301, before the Honorable Jennifer F. Bailey. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
