NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned J. Patrick Jones, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Cabell West Virginia, and by Deed of Trust dated November 15, 2019, executed by Alexander G. Vence to P. Andrew Vallandingham and Samuel Vallandingham, Trustees, which deed of trust is of record in the Office of the Clerk of Cabell County, West Virginia, in Trust Deed Book 2760 at Page 742, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on January 21, 2021 at 12:00 NOON (Registration to begin at 11:30 a.m.) to the highest bidder at the east front door of the Courthouse of said County of Cabell, in Huntington, West Virginia, which real estate is more completely described as follows: A certain tract of land situate in the State of West Virginia, Cabell County, City of Huntington, being all of Lot Number 26, Pleasant Valley Estates (un-recorded). and being more particularly bounded and described as follows: BEGINNNING at a 5/8″ x 32″ reinforcing rod with red plastic cap stamped “Eastham & Associates” (set) a corner common to Lot’s 25C & 26C, and being on the southerly right-of-way line of Woodhaven Drive, and being in the lands now owned by Guyan Holding, LLC, (D.B. 1227, Pg. 395); thence, leaving the said drive and with the said Lot 25C, severing the lands of the said Holding, LLC, South 69 49′ 26″ West 193.07 feet to a 5/8″ x 32″ reinforcing rod with red plastic cap stamped “Eastham & Associates” (set) on the north line of Common Area “C”; thence, leaving the said Lot 25C, and with the said Common Area “C”, continuing to sever the lands of the said Holdings, LLC, North 24 06′ 35″ West 181.60 feet to a 5/8″ x 32″ reinforcing rod with red plastic cap stamped “Eastham & Associates” (set) on the east right-of-way line of Matthew Lane; thence, leaving the said Common Area “C”, and with the east right of way line of the said Lane, as follows: North 56 24′ 03″ East 65.57 feet to a 5/8″ x 32″ reinforcing rod with red plastic cap stamped “Eastham &Associates” (set); thence, with a curve to the right, having a radius of 60.00 feet, and an arc length of 77.22 feet, the long chord of which bears: South 86 43′ 51″ East 72.00 feet to a 6″ concrete monument (set), on the south right-of-way line of the said Drive; thence, leaving the said Land, and with the south right-of-way line of the said Drive with a curve to the right, having a radius of 180.00 feet, and an arc length of 17.83 feet, the long chord of which bears: South 47 01′ 29″ East 17.82 feet; thence, continuing with the said Drive, South 44 11′ 14″ East 166.23 to the PLACE OF BEGINNING, containing 0.688 acre; more or less, as surveyed under the direct supervision by Jeffrey M. Eastham, West Virginia Professional Surveyor No. 2067, on September 8, 2005, and being all of Lot 26C as shown on the attached plat and made a part of this description which was prepared on April 10, 2018. The above tract is a part of Last Source of Title Deed Book 1227, Page 395, in the Office of the Clerk of the County Commission of Cabell County, West Virginia. There is to be reserved and excepted a 10-foot utility easement along east side lot line, a 20 foot utility along the front and rear and west lot lines. There is to be a 20 foot building setback on east side lot line and a 25 foot building setback on the front and west lot lines and 20 foot building setback on the rear lot line of the above described parcel. The locations of all of the above easements and building setbacks as shown on the attached plat and made a part of this description. This survey is subject to all restrictions, reservations, right-of-ways, easements, utilities, covenants, exceptions, conveyances, leases and exclusions previously imposed and appearing of record, and those not of record. TERMS OF SALE 1. The successful bidder (“Purchaser”) shall pay a Ten Percent (10%) nonrefundable down payment payable to the Trustee at the conclusion of the auction with balance due and payable within forty-five (45) days from the date of the Sale payable by certified check, cashier’s check or wired funds. In addition to the sales price, the Purchaser will be responsible for a ten percent (10%) “Buyer’s Premium” which will be added to the final bid amount and due at time of sale payable to Joe Pyle Auction & Real Estate Services LLC to determine final aggregate contract price. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, right of ways and easements of any nature whatsoever 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
