NOTICE OF TRUSTEE’S SALE Notice is hereby given that by virtue of the authority vested in the undersigned Trustee by that certain Deed of Trust executed by Richard B. Shepard and Neil Bellville, to Charles W. Peoples, Jr., Trustee, dated April 26, 2019, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book 2737, at Page 58, by which was conveyed to the said Trustee, the real estate hereinafter described, to secure the payment of a certain security instrument (“note”) set out and described and referenced therein; and furthermore, Paul A Ryker, having been designated as Substitute Trustee by the document titled as “Notice of Substitution of Trustee”, recorded in the office of the said Clerk in Bonds, Contracts and Leases Book 406, at Page 420, default having been made in the payment of said note, and the said Paul A Ryker, Trustee, having been requested to do so by the owner and holder of said note, and having full and absolute power and authority in the premises, the said Paul A Ryker, Trustee, shall sell to the highest bidder, on Thursday, the 15th day of April, 2021, at 11:00 a.m., at the east door of the Cabell County Courthouse, in Huntington, West Virginia, the following described real estate: PARCEL NUMBER ONE: All that certain lot, piece or parcel of land situate in the City of Huntington, Cabell County, West Virginia, in that part of the said City of Huntington formerly known as the Town ofGuyandotte, and known and designated on the map of SOUTHLAND ADDITION, made by W.G. Wilkins Company Engineers, which map was recorded in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 141, at Page 95, as LOT NUMBER SEVEN (7), in BLOCK “L”, fronting 50 feet on South High Street and running back 140 feet to Moore Street. PARCEL NUMBER TWO: All that certain lot, piece or parcel of ground situate in the City of Huntington, Cabell County, West Virginia, in what was formerly the Town of Guyandotte and in the “Southland Addition” to said Town, known and designated on a certain map of said Southland Addition, made by W.G. Wilkins, Engineers, a copy of which map was filed in the office of the Clerk of the County Commission of Cabell County, West Virginia, and recorded in Deed Book 141, at Page 95, as Lot Number Eight (8) in Block L. TERMS OF SALE: 1. Cash in hand paid on the day of sale. 2. The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-way, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 3. The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-2-1. 4. The Beneficiary and/or Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 5. The Trustee and/or Substitute Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 6. The Trustee and/or Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
