PUBLIC NOTICE OF UNIFORM ENVIRONMENTAL COVENANT ACT-LEAKING UNDERGROUND STORAGE TANK PROGRAM SITE CLEANUP METHOD PUBLIC NOTICE NO.: UECA-LUST #18019 NEWSPAPER: Herald Dispatch PUBLIC NOTICE DATE: May 19, 2021 The Office of Environmental Remediation (OER) at the West Virginia Department of Environmental Protection has approved a cleanup method to address environmental conditions at Loudermilk’s Chevron under the Uniform Environmental Covenant Act-Leaking Underground Storage Tank Program (UECA-LUST #18019). The applicant, Carl R. Loudermilk, has been working with the WVDEP since negotiating a UECA-LUST Agreement on February 28, 2018. The site is located at 2424 Adams Avenue, Huntington, Cabell County, West Virginia, and is comprised of approximately 0.29 acres of property. The facility currently dispenses fuel as a Sunoco branded filling station with automobile maintenance garage. Leak #07-069 was assigned to the site following the discovery of a gasoline release during the removal of the previous underground tank system. EnviroProbe defined and evaluated the type and magnitude of potential human and ecological exposures to the Contaminants of Concern (COCs) at the site. COCs were identified in subsurface soil and soil gas at the site and include benzene and ethylbenzene. Both COCs met the industrial use risk-based concentrations. The enactment of a deed restriction prohibiting the development of the site for residential purposes was selected as the appropriate remedy. This restriction will prohibit residences as well as other residential uses such as childcare, school facilities and nursing homes. Upon completion of remediation, the applicant will submit a Final Report, documenting that all work is complete. Applicant(s): Carl R. Remediation Standards and Exposure Control Methods: Industrial RBC standards achieved at this site. Both surface and subsurface soil met industrial RBCs. Groundwater met the groundwater RBCs and soil gas met the commercial VISLs.
