NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned Joel P. Jones, Jr., Substitute Trustee by Notice of Substitution of Trustee, which notice is of record in the Office of the Clerk of the County of Commission of Cabell County, West Virginia, and by Deed of Trust dated April 25, 2018, executed by Betlyn-Lyons, LLC to J. Grant McGuire and J. Patrick Jones, Trustees, which deed of trust is of record in the Office of the Clerk of Cabell County, West Virginia, in Trust Deed Book 2701 at Page 643, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on July 20, 2021, at Noon (Registration to begin at 11:30 a.m.) to the highest bidder at the east front door of the Courthouse of said County of Cabell, in Huntington, West Virginia, which real estate is more completely described as follows: PARCEL ONE: All that certain lot or parcel of land situate in Union District, Cabell County, West Virginia, bounded and described as follows: BEGINNING at a point in the West line of the Ohio River Road, 12 feet West of the back of the curb of said road, which point is distant W. 7 21′ E. 255 feet from an iron pin in said road marking the North-East corner of the 24.9 acre tract conveyed to Harry V. Sanns by. John M. Sanns and wife by deed dated April 30, 1918 and of record in the Office of the Clerk of the County Commission of Cabell County in Deed Book 156, at page 92; thence with the said West line of the Ohio River Road S. 7 21′ E. 80 feet to a stake; thence leaving said road line and running parallel to the North line of the aforesaid 24.9 acre tract N. 79 30′ W. 275 feet; thence N. 7 21′ W. 80 feet; thence parallel to the aforesaid North line of the said 24.9 acre tract S. 79″ 30′ E. 275 feet to the BEGINNING, and containing 0.5 acre more or less. PARCEL TWO: That certain tract of land situate in Union District, Cabell County, West Virginia, described as follows: BEGINNING at an iron pin in the West line of Sanns Drive; from said iron pin it is N. 85-30′ W. 11.2 feet to an 8 inch pine tree and S. 15-45′ W. 42 feet to an 8 inch pine tree; thence leaving said Sanns Drive N. 77-45′ W. 339.60 feet to an iron pin in the East line of W. Va. St. Rt. 2; thence with said line N. 13-26′ W. 21 feet to a point; thence continuing with Rt. 2 curving to the right at a radius of 2799.79 feet a distance of 139.81 feet to an iron pin; thence leaving said Rt. 2 S. 77-45′ E. 97 feet to an iron pin; thence S. 5-36′ E. 80 feet to an iron pin; thence S. 77-45′ E. 268.55 feet to an iron pin in the West line of Sanns Drive; thence with Sanns Drive S. 0-47′ E. 47.50 feet to a point in Sanns Drive; thence continuing with Sanns Drive S. 1-25′ E. 23.50 feet to the place of BEGINNING. Containing 0.72 acre more or less as shown on a plat by B &. D Surveying, Danny Jones, Registered Surveyor, dated December 3, 1973. EXCEPTING from PARCEL ONE and PARCEL TWO a .68 acre parcel conveyed to Jennifer Leighanne Martin by deed dated September 21, 2007 and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia in Deed Book 1178, at page 525. TERMS OF SALE 1. The successful bidder (“Purchaser”) shall pay a Ten Percent (10%) nonrefundable down payment payable to the Trustee at the conclusion of the auction with balance due and payable within forty-five (45) days from the date of the sale payable by certified check, cashier’s check, or wired funds. In addition to the sales price, the Purchaser will be responsible for a ten percent (10%) “Buyer’s Premium” which will be added to the final bid amount and due at time of sale payable to Joe Pyle Auction & Real Estate Services LLC to determine final aggregate contract price. Remote and/or online bidding may also be permitted. Please contact the auction company in advance of the sale to arrange for remote bidding. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, right of ways and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
