NOTICE OF SUBSTITUTE TRUSTEE’S SALE NOTICE IS HEREBY GIVEN that by virtue of authority vested in the undersigned Substitute Trustee by that certain Deed of Trust executed by James C. Stapleton, to Flynn, Max, Miller & Miller, L.C., Trustee, dated the 20th day of April, 2020, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Trust Deed Book No. 2774, Pg. 657, which conveyed unto the said Trustee the hereinafter described real estate to secure the payment of that certain indebtedness set out and described therein, and by Substitution of Trustee Agreement dated the 5th day of August, 2020, and recorded in said Clerk’s Office in Bonds, Contracts and Leases Book No. 405, Pg. 459, wherein the undersigned Trustee was appointed as successor to Flynn, Max, Miller & Miller, LC., Trustee, and default having been made pursuant to said Deed of Trust, said Successor Trustee, Paul J. Prunty as Trustee, having been requested so to do by the owner and holder of said indebtedness, shall sell to the highest and best bidder, on Friday, the 25th day of June, 2021, at 10:00 a.m. at the east front door of the Courthouse of Cabell County, West Virginia, the real estate commonly known as 903 Jackson Avenue, Huntington, West Virginia, and described as follows: All that certain lot, piece or parcel of ground situate in the City of Huntington, Cabell County, West Virginia, known and designated on that certain map of CENTRAL CITY now the City of Huntington, made by George McKendree, Engineer, which map was filed in the Office of the Clerk of the County Court of Cabell County, West Virginia, on October 3, 1891, as PART OF LOTS SEVENTEEN (17), EIGHTEEN (18),NINETEEN (19), TWENTY (20), TWENTY-ONE (21) and TWENTY-TWO (22), IN BLOCK NUMBER FORTY-SIX (46), being bounded and described as follows: BEGINNING at a point of intersection of the south line of Jackson Avenue with the west line of 9th Street West, as shown on the aforesaid map; thence running southerly along the westerly line of said 9th Street West, 80 feet to a point; thence running westerly and parallel with the south line of Jackson Avenue, 160 feet to a point; thence running northerly and parallel with the said westerly line of 9th Street West, 80 feet to a point in the south line of Jackson Avenue; thence running easterly along the said south line of Jackson Avenue 160 feet to the point of BEGINNING. TERMS OF SALE: Cash in hand on day of sale, subject to real property taxes assessed and unpaid against said property.
