IN THE CIRCUIT COURT OF WAYNE COUNTY, WEST VIRGINIA IN RE: THE REMAINS OF WALTER SHELTON MEADE AND BRENDA MEADE AND ANTHONY JOSEPH MEADE CIVIL ACTION: 50-2021-P-29 JUDGE: YOUNG NOTICE OF HEARING TO: Mary Eves, Wanda Bender and to any surviving next of kin and heirs at law of Walter Shelton Meade, Brenda Meade and Anthony Joseph Meade and their beneficiaries, devisees or legatees, administrators, executors, successors, their power of attorneys, or personal representatives; and to Mary Eves and Wanda Bender and to the owners, lessees, trustees, board of directors, or their surviving next of kin, heirs at law, beneficiaries, devisees or legatees, administrators, executors, successors, power of attorneys or personal representatives, of an area of land commonly known as, or used for the purpose of a graveyard, which area of land is located in Pritchard, Butler District of Wayne County, West Virginia, and having the following legal description: “This land herein conveyed is a part of a Military Land Grant made by the State of Virginia in early day. The beginning or corner of this land herein conveyed is on a division line of this Military Land Grant and at the North East corner of the New Hatton Grave-yard marked by a concrete marker. The land adjoining on the North is owned at present by Dameron. Then running almost due East with the said division line which is also the Dameron Line a distance of One Hundred and twelve feet (112) to a point. Thence turning at approximately a 90 degree angle and running with a straight line almost due South to the North East corner of the Old Hatton Burk grave-yard (corner on a cedar tree about five inches in diameter). Then turning at approximately a 90 degree angle and running almost due west with the line of the Old Hatton Burk grave-yard a distance of approximately One Hundred and Twelve fee (112) . Thence turning at approximately a 90 degree angle and running with the line of the New Hatton Grave-yard in a Northerly direction to the point of beginning, being and containing approximately 14,336 square feet be the same more or less.” This being the same area of land that was deeded to Walter Meade from Virgil Hatton and Daisy Hatton by deed dated the 8th day of September, 1953 and is filed in the records of the Wayne County Commission at Deed Book 286, Page 418. Please take notice that on the 8th day of July, 2021, at the hour of 9:00 a.m., the Petitioner, Brenda Meade, will bring on for hearing her Petition for an Order of Reinternment of Walter Meade, Brenda Meade and Anthony Joseph Meade, “Petition for Reinternment”. This hearing will come on before the Honorable James H. Young in his Courtroom located on the second floor of the Wayne County, Courthouse, 700 Hendricks Street, Wayne, West Virginia. The object of the Petitioner’s Petition for Reinternment is to obtain Court permission to relocate the graves of Walter Shelton Meade, Brenda Meade and Anthony Joseph Meade from their current place of burial to the Rosemont Cemetery located at 1057 Big Ben Bowen Highway, Huntington, Cabell County, West Virginia. The Petitioner has retained the services of a licensed funeral director to assist with the tasks of removing, transfer and reinterring the remains. If Court permission is granted, reinternment will be done with care, decency and reverence. The Petitioner will bear all costs. To protect your interests, you must appear at the said hearing to object, if you so desire.
