NOTICE Local Notice as Part of the Environmental Notification Process for the Registration of Antenna Structures TowerCo is proposing to install antennae on a new telecommunications tower called WV0143 Arnett at 212 Old Rich Hill Road, Arnett, WV (37-49-51.3 N and 81-25-12.1 W). The height of the self-support tower will be 93.9 meters above ground level (697 meters above mean sea level). The tower is anticipated to have FAA Style E (L-864 / L-865 / L-810 / E-1) – Medium Intensity Dual Lighting. Specific information regarding the project is available by emailing [email protected] during normal business hours. Interested persons may review the application for this project at www.fcc.gov/asr/applications by entering Antenna Structure Registration (Form 854) file no. A0975466. Interested persons may raise environmental concerns about the project under the National Environmental Policy Act rules of the Federal Communications Commission, 47 CFR c1.1307, by notifying the FCC of the specific reasons that the action may have a significant impact on the quality of the human environment. Requests for Environmental Review must be filed within 30 days of the date that notice of the project is published on the FCC’s website and may only raise environmental concerns. A Notice of Violation was mailed on March 31, 2015 and was received on April 3, 2015.

The Monongalia County Abandoned and Dilapidated Property Enforcement Agency began an investigation of the property described above and located on University Avenue, Monongalia County, West Virginia. As a result of this investigation, the Agency made the determination that this property is unsafe and a condition exists that is dangerous or detrimental to the public health, safety and/or welfare in violation of WV Code 7-1-3(ff).
To bring this property into compliance with the State Law and the Ordinance as adopted by the Monongalia County Commission on August 4, 1998, amended on June 27, 2001, and amended on July 14, 2004, the owner must complete the Agency recommendations that the remaining debris from the building be removed. As of this date the cleanup has not been completed, therefore, since more than thirty days have elapsed, the Monongalia County Commission did approve this Complaint that in the event the property is not cleaned up and removed within the sixty day period beginning the day this notice is received (July 1), a fine of $100.00 per day will be implemented beginning August 29, 2015. At the end of the next 90 day period November 27, 2015 the file will be turned over to the Prosecuting Attorney for action in Circuit Court resulting in the possible sale of the property at a public auction to be published at a later date.
Unless the Owner (or other interested party) of the property files with the County Clerk a written request for a hearing within ten (10) days of receipt of this Complaint, the Commission will proceed to turn the file over to the Prosecuting Attorney for action in Circuit Court.
