The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated September 14, 2009, and duly recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed of Trust Book 1716, at Page 745, Gregory W. Phillips, Jr. and Fonda L. Holehouse did convey unto Todd Taylor and Dan Kennedy, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Monongalia County Courthouse, in Morgantown, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Morgan District, Monongalia County, West Virginia, and more particularly described as follows:
All that certain lot or parcel of real estate together with the buildings and improvements thereon and the appurtenances thereunto belonging, situate, lying and being in Morgan District, Monongalia County, West Virginia, and more particularly bounded and described as follows:
All of Lot No. 9, Block B, of the Wedgewood Addition, as shown on a plat recorded in Deed Book 1131, at page 618, which was prepared by Blue Mountain Engineering, and which said lot is more particularly bounded and described as follows:
Beginning at a point, standing in the northern limits of Poplar Drive and being a common corner to Lot 8, the point of beginning, thence with a line of Lot 8 N. 42°52’57" E. a distance of 202.00 feet to a point, being a common corner to Lot 8 and standing in a line of the lands of A & M Corp.; thence with A & M Corp. for two lines S. 63°10’05" E., a distance of 22.67 feet to a point; thence S. 42°05’05" E., a distance of 116.66 feet to a point, standing in a line of A & M Corp. and being a common corner to Lot 10; thence with a line of Lot 10 S. 42°52’57" W., a distance of 198.04 feet to a P/K nail in a tie curb (found), being a common corner to Lot 10 and standing in the northen limits of Poplar Drive; thence with the limits of said drive N. 47°07’03" W., a distance of 138.00 feet to the point of beginning, and containing 28,078 square feet or 0.645 acres.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 681 Poplar Drive, Morgantown, WV 26505.
AND BEING the same real estate which was conveyed to Gregory W. Phillips, Jr. and Fonda L. Holehouse by Deed dated August 11, 2009, from Fonda L. Holehouse, and recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book 1392, at Page 464.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
