McNutt Avenue, Bluefield, West Virginia 24701 Upon notification by the holder of a Note secured by the Deeds of Trust described below of a default and having been requested to institute these proceedings, and by virtue of the authority vested in us under that certain Deed of Trust dated the 16th day of June, 2005, executed by Drema McPeak unto Phillip B. Ball and William C. Hopkins, as Trustees, which said Deed of Trust is of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1046, at Page 519, which said Deed of Trust secured First Community Bank, and for which a Substitution of Trustee was recorded substituting Thomas S. Lilly for William C. Hopkins, recorded in the said Clerk’s Office in Trust Deed Book 1290 at page 232, as well as that certain Deed of Trust dated November 20, 2007, executed by Drema McPeak unto Steven M. Feola and Gary R. Mills, as Trustees, which said Deed of Trust is of record in the said Clerk’s Office in Trust Deed Book 1129 at page 693, and by Substituion of Trustee, substituting Thomas S. Lilly and Phillip B. Ball, recorded in Trust Deed Book 1290 at page 231, we will ON THE 9th DAY OF March, 2015 AT 10:00 O’CLOCK A.M., at the front door of the Mercer County Court House at Princeton, Mercer County, West Virginia, offer for sale at public auction to the highest bidder, the following residential property, to-wit: The following described real estate, located just north of the City of Princeton in East River District, Mercer County, West Virginia, recorded as Microfilm Plat # 14313, and more particularly bounded and described as follows: “BEGINNING at a point in the east line of McNutt which lies S 5? 43′ W 96.45 ft. from the south line of Estill Street; thence S 78? 37 E 165.20 ft. leaving McNutt Avenue and running to the northwest corner of Lot 18, Section 12 to the north line of an alley; thence N 49? 50′ W., 96.46 ft. with the north line of said alley to the east line of McNutt Avenue; thence N 5? 43′ E 85.45 ft. with the east line of McNutt Avenue to the BEGINNING and containing 0.33 acre more or less. And being the same property conveyed unto Drema McPeak by deed of Carol R. Treolo, et. al., dated March 27, 2001, and of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 830 at page 254. “This conveyance is made subject to all and singular, the exceptions, reservations, covenants, conditions, and limitations contained in all prior deeds conveying said real estate, the same as though set out herein in extenso.” The terms of the sale shall be cash in hand on the day of sale (or such other arrangement as may be satisfactory to Trustee and holder of the Note) and said property is being sold in “as is” condition. Said sale is subject to all taxes now due or to become due on said property, all liens, including but not limited to sewer liens and restrictions, easements or other matters of record in said Clerk’s Office affecting the title to said property. The purchaser is to pay the excise tax on the privilege of transferring said real estate. In the event there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale, or the period allowable for redemption under local law, whichever is longer.
