TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 15, 2013, and duly recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Document No. 503001, in Book No. 1941, at Page 013, Robert L. Musgrove, II and Amanda M. Musgrove did convey unto Daniel A. Oliver, Esq., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated February 6, 2017, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Caliber Home Loans, Inc. to foreclose thereunder, will offer for sale at public auction at the front door of the Monongalia County Courthouse in Morgantown, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Grant District, Monongalia County, West Virginia, and more particularly described as follows:

All of the following lot or parcel of land, together with the improvements thereon, and appurtenances thereunto belonging, situate, lying and being in Grant District, Monongalia County, West Virginia, and being more particularly bounded and described as follows:
BEGINNING at an iron pin, set, in the middle of a cul-de-sac at the end of a twenty foot (20′) wide right of way, which cul-de-sac center pin is a common corner to Lots 7 (conveyed to Alberta Reeder, by deed dated November 7, 1985, of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book 936, at Page 152), 8, 9, and 10 in the subdivision of said Kerns property, and running thence with the center line of said twenty foot (20′) right of way and Lot No. 8, N. 81° 09′ 27" East 194.50 feet to an iron pin set, in the center of said right of way, a corner to other undivided land of Earl H. Kerns, Sr. and Jessie Louis Kerns; thence with the Kerns land, S. 15° 52′ 53" East 211.75 feet to an iron pin, set, corner to land of Randy J. and Kimberly D. Mocniak (Deed Book 946, at Page 38); thence with a line of said Mocniak, and undivided land of Kerns, S. 80° 25′ to" West 150.14 feet to an iron pin, set, corner to Lot No. 9; thence with the eastern line of Lot No. 9, N. 19° 35′ 14" West 216.27 feet, to the point and place of beginning, containing 0.910 acre, more or less, and being Lot No. 10 of the Subdivision of Lots of Earl H. Kerns, Jr., as shown on a plat of survey prepared by Joseph Bundy, LLS No.,234, dated December 18,.1986, of record in said Clerk’s Office in Deed Book 962, at Page 69.
And being all of the same property conveyed to Robert Musgrove, II and Amanda Musgrove, husband and wife, by virtue of a deed to them dated May 15, 2013, from Christa J. Haines and Stefan Lowther, to be recorded immediately prior hereto.
The above-described deed and plat references are here made for a more particular description and for all pertinent purposes whatsoever.
This conveyance is made together with all buildings and improvements, rights, roads, ways, easements, privileges, appurtenances, and advantages thereunto belonging or in any way appertaining
This conveyance is specifically made subject to all reservations, agreements, exceptions, land use regulations, covenants, conditions, rights-of-way, restrictions, prior out conveyances, prior conveyances of minerals and rights to extract the same, and easements all as contained in prior deeds of conveyance and documents of title affecting the above described real estate, and those shown on all recorded plats of survey.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 20 Hillview Ests, Morgantown, WV 26501-7757.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
