This action seeks partition of certain mineral interests underlying certain property located in Clay District, Monongalia County, West Virginia (“Subject Minerals” ) pursuant to West Virginia Code Section 37-4-1 et seq. The surface estates overlying the Subject Minerals are identified by the Monongalia County Assessor’ s Office as Clay District, Tax Map 16, Parcel 44; Tax Map 16, Parcel 45; Tax Map 16, portion of Parcel 48; Tax Map 16, portion of Parcel 48.3; and Tax Map 16, portion of parcel 19.
It appearing by affidavit filed in this action that Plaintiff Northeast Natural Energy LLC has exercised due diligence to ascertain the residence and whereabouts of Defendant Emerald B. Eberhart, and that Defendant Emerald B. Eberhart cannot be located or contacted, it is hereby ORDERED that Defendant Emerald B. Eberhart must appear and serve upon Plaintiff Northeast Natural Energy LLC’ s counsel, Allison J. Farrell and Braden L. Christopher of the law firm Steptoe & Johnson PLLC, 400 White Oaks Boulevard, Bridgeport, WV 26330, an Answer or other defense to the Amended Complaint filed in this action by September 7, 2017, which is not fewer than thirty days after the date of first publication of this notice, otherwise judgment by default will be rendered against them at any time thereafter.
A copy of the Amended Complaint can be obtained from the Circuit Clerk’ s Office in the Monongalia County Courthouse located at 75 High Street, Suite 12, Morgantown, WV 26505.
