TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 23, 1996, and duly recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Document No. 9225863, in Book No. 836, at Page 120, Cecil E Gum and Debra K Gum did convey unto Douglas C. McElwee, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S. Bank National Association, as Trustee, as successor to Firstar Trust Company, as Trustee, for Manufactured Housing Contract Senior/Subordinate Pass-Through Certificate Trust 1997-6 to foreclose thereunder, will offer for sale at public auction at the front door of the Monongalia County Courthouse in Morgantown, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 01 – Battelle District, Monongalia County, West Virginia, and more particularly described as follows:

All of those certain tract or parcels of real estate, situate, lying and being at or near the Village of Wana, on the waters of Miracle Run, in Battelle District, Monongalia County, West Virginia, and which are more particularly bounded and described as follows:

First: Beginning at a stake corner to othre land of Helen Eddy, thence S 13 degrees 15′ East 149.2 feet to a point in the road, thence South 87 degrees 45′ West 208 feet to a point, thence North 81 degrees 40′ West 159.6 feet, corner to lands of Helen Eddy, thence North 2 degrees 08′ East 72.4 feet to a point, thence North 80 degrees 00′ East 336 feet to the place of beginning, containing 0.948 acres, more or less.

Second: Beginning at a point in West Virginia Route No. 15 corner of property of Jesse Price 0.948 acres parcel; thence with two lines of said Jesse Price land, North 2 degrees West 72.40 feet to a post, North 75 degrees 27′ East 336 feet to a point corner to said Jesse Price land and in a boundary line of other lands of Helen Eddy; thence with lands of said Helen Eddy four lines, North 13 degrees 59′ West 69.28 feet to a steel pipe along a fence, South 77 degrees 27′ West 319.78 feet to an iron pipe, South 81 degrees 32′ West 84.05 feet to an old jack, North 86 degrees 31′ West 257.52 feet to an iron pin in a fence line of Orval Haught; thence with said fence line of Orval Haught, South 16 degrees 35′ East 121.96 feet in the center of said West Virginia Route No. 15; thence with centerline of said roadway two lines, North 89 degrees 59′ East 127.11 feet, South 77 degrees 47′ East 189.02 feet to the point and place of beginning, containing 1.449 acres, more or less.

Being the same property granted and conveyed to Jim Walker, by Deed of Gary M. Kennedy and Linda L. Kennedy, his wife, by Deed dated the 28th day of April, 1981, and recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book Volume 852, page 483.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: Route 67 Box 1517, Wana, WV 26590.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
