NOTICE OF TRUSTEE SALE Pursuant to the authority vested in the undersigned by deed of trust dated the January 12, 2007, signed by Bobby Honaker and Sue Ann Honaker, of 379 Maynard Road, Spanishburg, West Virginia 25922, to Amy L. Mann, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Court of Mercer County, West Virginia, in Trust Deed Book 1101 at page 125, and the Trustee, Amy L. Mann, having been requested so to do by the Lender, and default having been made under the terms and conditions of said deeds of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Lender and present holder of the note, said Trustee will sell at public auction at 1:30 o’clock p.m. on the: Tuesday, April 7th, 2015 at the front doors of the Courthouse in Mercer County, West Virginia, the following described real estate: Rock District, Mercer County, West Virginia BEGINNING at a point in the old original Raleigh-Grayson turnpike, which point is about 15 feet from a white oak standing in the J.L. Goad property, thence running with the road, N. 84 30′ E., 250 feet; thence S. 80 45′ E., 126 feet; N. 85 59′ E., 400 feet; thence N. 48 50′ E., 60 feet to the middle of Wolf Creek; thence crossing Wolf Creek, N. 48 15′ E., 38 feet to a stake; thence N.11 15′ E., 208 feet to a corner of the Mill Lot; thence running with the line of Mill Lot S. 58 45′ E., 18.5 feet to a stake; thence N. 44 10′ E., 57.5 feet to a stake in the south right of way line of U.S. Route 19 and 21; thence running with said U.S. Rout 19 and 21, S. 57 10′ E., 217 feet; thence S. 69 E., 100 feet; S. 86 10′ E., 100 feet; thence N. 80 E., 100 feet; N. 76 30′ E., 530.5 feet to a stake in the right of way line of said Route 19 and 21 (approximately opposite Station 108 plus 85); thence leaving the road S. 33 1691 feet to the top of a ridge, line of G. W. Akers and corner to A.W. Akers; thence along the top of ridge, S. 65 20 W., 46.4 feet; thence S. 62 50′ W., 182.2 feet; S. 45 30′ W., 142.4 feet; S. 29 35′ W., 207.2 feet; S. 7 50′ W., 204 feet to a small dogwood, corner to R.L. Delp; thence running with, former surveys; along top of ridge N. 86 W., 690 feet to a sourwood, called for in old surveys; thence according to sold surveys’ thence according to old surveys, S. 86 W., 10 poles to four blackoaks; thence N. 68 116 poles to a point in old Raleigh-Grayson Turnpike; thence running with said old Raleigh-Grayson Turnpike, N. 1 E., 227 feet; N. 41 E. 124 feet; N. 11 45′ E., 183 feet; thence N. 25 30′ E., 70 feet; N. 72 E., 160 feet, N. 64 E., 50 feet; thence N. 22 30′ W., 60 feet; N. 24.30′ E., 70 feet; thence N. 61 E., 156 feet to the point of BEGINNING, and containing about 120 acres, more or less. It is hereby covenanted that all reservations and exceptions set out in that certain deed of August 27, 1946 from Leah M. Blankenship and husband to J.L. Goad, as to legal highways, and right of way over the said tracts of land, and a small graveyard, together with the right of ingress and egress thereto, are hereby expressly excepted and reserved from the operation of this instant conveyance. THERE is further herein GRANTED and CONVEYED that certain Oil and Gas Leas dated November 11, 1999, from Maynard B. Honaker unto Dominion Appalachian Development, Inc. of record in the aforesaid Clerk’s Office in Oil and Gas Leas Index 18 at page 190. AND BEING the same property conveyed unto Bobby F. Honaker and Sue Ann Honaker, his wife, from Joan M. Honaker Griffith, et als., by deed dated November 30, 2000 and of record in the Office of the Clerk of the County Court of Mercer County, West Virginia, in Deed Book 847 at page 339. It is the intention of this notice to sell the secured property by property description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above-described real estate is reported to have a mailing address of 379 Maynard Road, Spanishburg, West Virginia 25922. TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence, payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property, it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale, which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises unto the Trustee Deed is delivered or recorded. A third party purchaser at sale may be required to pay the purchase price plus all recording and transfer fees. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this ale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry.
