NOTICE OF SALE OF REAL ESTATE
The undersigned, George Y. Chandler, being the duly appointed Special Commissioner under that certain Order entered by the Circuit Court of Wood County, West Virginia, shall appear and sell at public auction on November 6, 2015, at 9:00 a.m., at the front door of the Courthouse in Wood County, West Virginia, the following tracts of real estate:
Those certain six (6) tracts of real estate more or less, and being situate on the waters of Steele District, Wood County, West Virginia, more particularly bounded and described as follows:
TRACT ONE:
BEGINNING at a point marked by an iron pin in the Raymond Buchanon line, 30 feet south of an iron pin which marks the boundary line between Garfield Prineás land and Raymond Buchanonás land, and running thence N. 73õ W. 169á 10ã to an iron pin; thence N. 88õ 30á W. 103á2ã to an iron pin; thence N. 67õ W. 53á 11ã to an iron pin; thence N. 38õ W. 48á 8ã to an iron pin; thence N. 1õ W. 28á 4ã to an iron pin; thence N. 40õ 30á E. 269á to an iron pin; thence N. 70õ E. 60á to a concrete post; thence S. 52õ 30á E. 112á 6ã to an iron pin; thence S. 72õ E. 106á to an iron pin; thence S. 16õ W. 274á 5ã, more or less, to the place of beginning, containing 2.17 acres, be the same more or less. Together with a right-of-way for ingress and egress to and from the property heretofore described, being 10 feet in width on either side of a line, described as follows:
BEGINNING at a point in the westerly most boundary line and 12 feet north from an iron pin heretofore mentioned in the above description and running thence in a northwestern direction N. 68õ W. 104 feet; N. 72õ W. 236 feet and 1 inch; N. 79õ W. 149 feet and 5 inches; N. 44õ W. 116 feet and 9 inches; N. 67õ W. 203 feet and 8 inches; N. 71õ 30á W. 103 feet and 10 inches; N. 85õ W. 130 feet and 6 inches to the line of a common road.
TRACT TWO:
BEGINNING at an iron pipe at the southeasterly corner of the 2.17 acre tract of land conveyed to Ishmael Junior Johnson and Wilma Johnson by Andrew J. Holbert, et al., by deed dated the 16th day of September, 1955, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in. Deed Book 392, at page 445, also corner to Buchanon and Holbert, and thence with the Holbert east line, S. 16õ W. 94.8 feet to an iron pipe; thence N. 76õ 20á W. 454 feet to a copper pipe; thence N. 39õ W. 145.6 feet to another copper pipe; thence N. 1õ 46á E. 232.8 feet to an iron pipe; thence N. 85õ 30á E. 662.5 feet to an iron pipe, corner to Holbert and Buchanon; thence S. 16õ W. 160 feet to the northeast corner of the aforesaid Johnson tract; and thence continuing with the easterly line of said Johnson tract, S. 16õ W. 274.42 feet to the place of beginning, excepting, however, the tract of 2.17 acres lying within the above boundaries, heretofore conveyed to Ishmael Junior Johnson and Wilma Johnson by Andrew J, Holbert, et al., as aforesaid. The tract hereby conveyed contains 3.5 acres, more or less, and all of said land is more particularly shown on the plat thereof, prepared by Paul E. Marshall, County Surveyor, dated February 2, 1958, which plat is attached to that certain deed recorded in Deed Book 418, at Page 56, in the aforesaid Clerkás Office.
TRACT THREE:
BEGINNING at an iron pin and stake at the northwesterly corner of the 3.5 acre tract of Ishmael J. and Wilma Johnson, as shown on the plat of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 418, at page 56-A, and thence N. 2õ E. 176 feet to an iron stake; thence N. 39õ E. 439 feet to a stake in the fence line of Cox; thence S. 76õ E. with the Cox line 495 feet to a stake in the Anderson line; thence with the Anderson and Buckhanon line S. 16-1/2õ W. 253 feet to the northerly line of the 3.5 acre Johnson tract, hereinbefore mentioned; and thence with the said northerly line of the Johnson tract S. 85õ 30á W. 662.5 feet to the place of beginning, containing 5-1/2 acres, more or less, as surveyed by Frank Daniell on the 15th day of October, 1958.
TRACT FOUR:
FIRST TRACT: Beginning at an iron stake corner to a tract now or formerly owned by K.G. Anderson and Geraldine Anderson, and running thence with a line of said tract S. 82- 1/2 E. 32-1/2 poles to a stake, which stake is 6-1/4 poles west of the limestone ridge road; thence S. 51-1/2 W. 25 poles and 13 links to an iron stake, a corner to a tract conveyed to Alton Whipkey and Eula Whipkey, his wife, be deed dated the 6th day of December, 1940; thence with a line of said tract N. 84 W. 19 poles to an iron stake, another corner to said tract; thence N. 10 E. 19 poles to the place of beginning, containing 2 acres and 44 poles, be the same more or less. But excepting from said conveyance 7/8 of the oil and all of the gas in and under said land as conveyed by J.H. Stephens and wife to Godfrey L. Cabot.
SECOND TRACT: BEGINNING at an iron stake at the corner of Perkins farm; thence N. 51-1/2õ E. 28 poles 3 links to iron stake; thence S. 84õ E. 16 poles and 16 links to iron stake; thence S. 10õ W. 19 poles 15 links to iron stake, the place of beginning. This land is sold by the lot and not by the acre, containing three acres, be the same more or less.
TRACT FIVE:
BEGINNING at a 2ã iron pipe (found), a corner of Ishmaelã Johnson (DB 425, P 569), thence with said tract; S. 04-56 W. 136.00 feet to a point, a corner of Ishmaelã Johnson (DB 418 P 56), thence with said tract; S. 04-41 W. 232.80 feet to a 3/4ã copper pipe (found), thence the next three courses with the interior of the original tract; N. 57-18 W 112.55 feet to a 1ã brass pipe (set), thence N. 45-37 W. 109.16 feet to a 1ã brass pipe (set), thence N. 4127 E. 307.35 feet to the place of beginning and containing 35,018.25 square feet, be it more or less, as shown on a plat of survey by Darrell R. Boice, Licensed Land Surveyor No. 667 of Elizabeth, West Virginia, dated April 22, 1986, which plat is attached to that certain deed recorded in Deed Book 833, at Page 145, in the aforesaid Clerkás Office.
TRACT SIX:
Right of Way and Easement
A permanent right of way and easement which shall remain open and unobstructed for ingress and egress to and from a tract containing 2.17 acres, more or less, described in deed dated September 16, 1955, from Andrew J. Holbert, et al, to Ishmael Junion Johnson and Wilma Johnson of record in the Office of the Clerk of the County Commission of Wood County, West Virginia in Deed Book 392, at Page 445, which permanent right of way and easement shall be 15 feet in width on either side of the line described as follows:
BEGINNING at a point in the westerly most boundary line and 12 feet north from an iron pin heretofore mentioned in the above description and running thence in a northwestern direction N. 68õ W. 104 feet; N. 72õ W. 236 feet and 1 inch; N. 79õ W. 149 feet and 5 inches; N. 44õ W. 116 feet and 90 inches; N. 67õ W. 20-3 feet and 8 inches; N. 71õ 30á W. 103 feet and 10 inches; N. 85õ W. 103 feet and 6 inches to the line of a common road.
The permanent right of way and easement hereby conveyed replaces and supersedes the 20 foot right of way and easement described in the deed last above referred to.
TERMS OF SALE: The above-listed tracts shall be sold together and not individually. The winning bidder for the tracts shall pay 10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} of the purchase price on date of sale, with the remaining balance due within 7 days of date of sale; payment for unpaid real estate taxes to be prorated at closing. The seller will specially warrant title to this property.
Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale and there is notice of the same. Should the undersigned not appear at the time appointed for the sale and there is no notice posted of a continuance, please contact the office of the undersigned to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the undersigned. The undersigned is fully vested with the authority to sell said property by Order of the Circuit Court of Wood County, West Virginia entered on the 22nd day of September, 2015, in Case No. 13-C-332.
Any sale of the subject property shall be made expressly subject to any and all restrictions, reservations, rights of way, and conveyances of record.
