(WITH PUBLIC SALE OF PERSONAL PROPERTY)
NOTICE IS HEREBY GIVEN by virtue of the authority vested in the undersigned Successor Trustee, Jonathan Nicol, by that certain Substitution of Trustee Agreement, dated December 16, 2015, executed by JPMorgan Chase Bank, N.A., successor by merger to Bank One, N.A., recorded in the office of the Clerk of the County Commission of Wood County, West Virginia, in Lien Book 1908 at page 110, being the same authority which was originally vested in Thomas Gilpin, as Trustee, as Trustee, in that certain Credit Line Deed of Trust, Assignment of Leases and Rents, Security Agreement and Financing Statement made by ALVA J. WATSON, a married adult, dated May 28, 2003, recorded in said Clerkás office in Lien Book 1115 at page 68, as amended of record, the maker of the instrument secured by said deed of trust is in default, and JPMorgan Chase Bank, N.A., the successor to the original lender named in said deed of trust, has elected to treat the whole principal debt thereby secured as immediately due and payable.
NOW, THEREFORE, the undersigned Successor Trustee, having been requested by JPMorgan Chase Bank, N.A. to do so, will proceed to sell at public auction at the front door of the Courthouse of Wood County, in the City of Parkersburg, West Virginia, at 11:00 oáclock a.m. on Wednesday, March 30, 2016, for cash in hand on the day of sale to the highest bidder, all of the following described real property, together with the improvements thereon and appurtenances thereunto belonging, situate in Wood County, West Virginia, and being more particularly bounded and described in said deed of trust as follows:
Real Estate lying and being in the City Parkersburg, County of Wood, State of WV and described as follows:
Beginning at a large steel pipe encased in concrete on the northerly side of the W. Va. Highway Route 2, which point is S. 14 degrees 9á W. 40.26 feet from the northwest comer of Lot 79 of the Addition hereinafter named; thence N. 14 degrees 9ã E. 147.65 feet to an iron pipe in the westerly line of Lot 81 of said Addition; thence N. 61 degrees 15á E. 91 feet to the northwesterly corner of a Lot conveyed by Fagen to Merville (Tract First as set forth in Deed Book 648, at page 131); thence S. 28 degrees 41á E. 107.74 feet with the northeasterly line of said Lot heretofore conveyed, to a point in the northerly line of State Route 2, the southwesterly corner of said Lot; thence S. 61 degrees 9á W. 191.30 feet to the place of beginning, being parts of Lots 79, 80. and 81 of Camden Farms Addition No. 2, a plat of which is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 2, at page 51.
This parcel is subject to all rights of way, easements and restrictive covenants of record.
Being the same real estate conveyed unto Alva J. Watson by Deed from Janet Michels and Ronald Michels, her husband, dated the 7th day of February, 2003, and of record in the aforesaid Clerkás Office in Deed Book 1049, at page 691.
The Real Property or its address is commonly known as 4541 Emerson Avenue, Parkersburg, WV 26101. The Real Property tax identification number is Tax Map 25, Parcel 0214.
In addition to the real property described above, this sale will also include that certain personal property collateral owned by Alva J. Watson and still located on the said real property at the time of this sale, which personal property is described as follows:
All inventory and equipment.
This sale is to enforce the rights of JPMorgan Chase Bank, N.A., as secured party, in the above-described collateral, which is the subject of that certain Commercial Security Agreement made by Alva J. Watson, as grantor, dated December 11, 2003.
The undersigned Successor Trustee reserves the right to adjourn this sale from time to time as the interests of the parties may require, and without any notice other than by oral proclamation at the time and place appointed for sale and further reserves the right to cancel the sale in his sole and absolute discretion. This sale shall be made subject to any prior lien, liens entitled to priority over the lien created by the subject deed of trust, restrictions, conditions, reservations and easements contained in deeds or instruments of record in said Clerkás office, and subject further to all unpaid real estate taxes and special assessments, if any, the purchaser assuming the payment thereof.
The undersigned Successor Trustee will deliver to the purchaser a deed conveying the subject property without any covenant or warranty, express or implied. The purchaser shall be responsible for the payment of any transfer taxes and recording fees necessary to place of record the aforesaid deed. The undersigned Successor Trustee further reserves the right to accept or reject any and all bids in his sole and absolute discretion.
In the event the subject property is occupied, the undersigned Successor Trustee shall be under no duty to cause any existing tenant or occupant to vacate the subject property.
