NOTICE OF SUCCESSOR TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Successor Trustee by that Deed of Trust, executed by borrowers, Tara L. Sizemore and Selwyn J. Sizemore, dated October 21, 2009, and recorded on October 27, 2009 in the office of the Clerk of the County Commission of Fayette County, West Virginia (the "Clerk's Office"), in Book 849, at Page 716. Matthew L. Ward and Ian G. Henry ("Successor Trustees") were appointed as Trustees by APPOINTMENT OF SUCCESSOR TRUSTEES dated June 4, 2025, and recorded in the Clerk's Office on June 9, 2025, in Book 1109, at Page 539. The borrower(s) have defaulted under the Note and Deed of Trust and the Successor Trustees have been instructed, by Pioneer Appalachia Federal Credit Union (fka Pioneer WV Federal Credit Union), to foreclose under the Deed of Trust. Accordingly, the Successor Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Fayette County, in Fayetteville, West Virginia, on:

The property is described as that certain parcel of land, together with all improvements thereon and the appurtenances thereto, and being more particularly described as follows:
The following described tract or parcel of surface land, together with the improvements and appurtenances thereunto belonging and the right incidental thereto, all that certain tract of land situate in the Village of Cannelton, Valley District, Fayette County, West Virginia, together with all the improvements thereon and appurtenances thereto and being more particularly bounded and described as follows, to-wit:
Lot No. 8-2 as shown upon that certain map entitled:
"October 1, 1939, Map Showing subdivision of Surface Tracts, Cannelton Coal & Coke Co., for sale by Valley Homes, Inc., Block B, Cannelton, Fayette Co., W.Va., Sale 1 inch = 50 feet", prepared by Kenneth F. Robbins, Engineer.
Said above described map is of record in the Office of the Clerk of the County Court of Fayette County, West Virginia in Map Book 15 at Page 2.
There is excepted and reserved from this conveyance
One: All oil, gas and other minerals in and under said lot or parcel of land, together with the right to remove the same. Provided, however, that in the removal of said oil, gas and other minerals no opening or entry for the removal of same shall be made on the surface of said parcel.
Two: All necessary and convenient rights-of-way and easements for existing water, sewage, power, gas, electric, telephone and other utility right-of-way lines, together with a right of easement for Cannelton Coal Company, a West Virginia corporation, its successors, grantees or assigns to enter upon said lot of land to maintain and repair said rights-of-way and lines.
Three: All rights-of-way and easements of every kind and character heretofore granted, sold and otherwise disposed of by Cannelton Coal Company, a West Virginia corporation, to any third party which is any wise affects said lot hereinabove described.
Four: Any and all reservations, restrictions and easements of record in the office of the County Clerk of Fayette County, West Virginia, if any, in any wise affecting said lot hereinabove described.
And being the same tract or parcel of real estate as was conveyed unto Selwyn J. Sizemore and Tara L. Sizemore, his wife, by Robert Allan Giacoma and Normal Jean Giacomo Jeffers, by deed dated the 6th day of November, 2002, and of record in the Office of the Clerk of the County Commission for Fayette County, West Virginia in Deed Book 590, at Page 638. Selwyn J. Sizemore having already passed on August 6, 2018.

TERMS OF SALE:
1. The property will be conveyed in an "AS IS, WHERE IS" physical condition by Deed containing no warranty, express or implied;
2. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever;
3.The purchaser shall be responsible for the payment of the transfer taxes imposed by Article 22 of Chapter 11 of the West Virginia Code;
4. The Beneficiary and/or Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale;
5. The Successor Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof;
6. The Successor Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY;
7. The total purchase price is payable to the Successor Trustee by cashier's check, cash or the equivalent within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale by cashier's check, cash or the equivalent.
