NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE
Pursuant to the authority vested in the undersigned by deed of trust dated the 25th day of February 2000, signed by Mercature LTD, Inc., to William P. Crites and W. James Reed, Trustees, which said deed of trust is of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Trust Deed Book 880, at page 851, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 11:30 o’clock AM on the
14th day of DECEMBER 2015
at the front doors of the Courthouse in Wood County in Parkersburg, West Virginia the following described real estate situate in City of Parkersburg, Wood County, West Virginia, as follows:
TRACT I: BEGINNING at a point, being the intersection of the Southwest side of Seventh Street with the Southeast side of an alley, 12 feet wide; running thence in a Southeasterly direction along the Southwest side of Seventh Street a distance of 75.26 feet to a point; thence in a Southwesterly direction a distance of 142.77 feet, more or less, to a point, being a corner of lands now or formerly of William A. Strouss, et al; thence in a Northwesterly direction along said lands of Strouss a distance of 68.83 feet, more or less, to a point in the Southeast side of said alley; thence in a Northeasterly direction along the Southeast side of said alley, a distance of 173.9 feet, more or less, to the point or place of beginning, being premises 214-216 Seventh Street, Parkersburg, West Virginia, as shown on a plat prepared by L.G. Merrill, Registered Professional Engineer, dated March 8, 1960, a copy of which is of record and by reference made a part hereof, together with the improvements thereon, and also together with all right, title and interest of the owners in and to all street, roads, avenues, alleys and rights of way abutting or in anywise appertaining to the property above described.
Being the same property conveyed unto Mercature, Ltd., Inc., a West Virginia Corporation, from Thomas E. Ryan and Michele M. Ryan, his wife, by deed dated December 27, 1985 and recorded in the office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 828 at page 757.
TRACT II: BEGINNING on Seventh Street at the West corner of the alley ninety-five (95) feet from Market Street and running thence toward Sixth Street in a line parallel with Market Street one hundred and forty and four-tenths (140.4) feet to a stake; thence at right angles and toward Juliana Street fifty (50) feet to a stake; thence at right angles and running toward Seventh Street one hundred and forty-two and thirty-five one hundredths (142.35) feet to Seventh Street; thence with Seventh Street forty-nine and one-half (49 1/2) feet to the place of beginning.
TRACT III: BEGINNING at the Easterly corner of a lot now or formerly owned by Anna Brenne, distant 190.83 feet from Juliana Street; thence towards Sixth Street and parallel with Juliana Street, 148.44 feet, a 10 foot alley opening from the lot hereby conveyed 133.44 feet from Seventh Street, and said alley affords an outlet from the back part of a lot; thence at right angles and towards Market Street 24.9 feet; thence at right angles and parallel with Juliana Street, 142.35 feet to Seventh Street; thence with the line of Seventh Street 24.9 feet to the beginning.
Being the same property conveyed unto Mercature, Ltd., Inc., a corporation, from Roy D. Spader and Frederick N. Linsell, individuals doing business as L&S Investments, and Mary Lynne Spader, wife of Roy D. Spader, and Brenda C. Linsell, wife of Frederick N. Linsell, by Deed dated May 23, 1986, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 833 at page 568.
TRACT IV: Situate at Street No. 614 Juliana Street, in the City of Parkersburg, County of Wood, and State of West Virginia, more particularly bounded and described as follows: BEGINNING at the Southeast side of Juliana Street, 149 feet and 6 inches from the original line of Washington (now Sixth) Street, and running thence toward the Northwestern Turnpike (now Seventh Street) 36 feet, thence at right angles 110 feet towards Market Street to an alley running from Washington (now Sixth) Street to the Northwestern Turnpike (now Seventh Street), thence with said alley towards Washington (now Sixth) Street 36 feet, thence at right angles 110 feet to the beginning.
TRACT V: Situate at Street No. 610-612 Juliana Street, in said City of Parkersburg, more particularly bounded and described as follows: BEGINNING at a point on the East side of Juliana Street between Sixth and Seventh Streets, eight-nine and twenty-three one-hundredths (89.23) feet North of Sixth Street; thence in a Northerly direction with Juliana Street thirty-nine and forty-seven one hundredths (39.47) feet, more or less, to a point in the line of property owned by the said Nellie A. Couch; thence with her line in an Easterly direction one hundred ten (110) feet to an alley; thence with the West line of said alley in a Southerly direction thirty-nine and eight-tenths (39.8) feet, more or less, to a point of the same, said point being eight-nine (89) feet from Sixth Street; thence in a Westerly direction one hundred ten fee (110) to Juliana Street, the place of beginning.
Being the same property conveyed unto Mercanture, Ltd, Inc., a corporation, from Albert Joe Couch and Naomi Blair Couch, husband and wife, by deed dated December 27, 1985, and recorded in the office of the Clerk of the County Commission of Wood County, West Virginia in Deed Book 828 at page 86.
TRACT VI: COMMENCING on the easterly side of Juliana Street at a point 120.29 feet southerly from the southeast corner of the intersection of Seventh Street and Juliana Street, as established by two arbitration line agreements, the first between James A. Wetherell, unmarried, and Racheal Wetherell, widow, and Pike Investment Company, bearing date the 12th day of September, 1905, and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 137 at page 321, and the second between James A. Wetherell, T.J. Wetherell, George W. Strong and Rowena Rauch, bearing the 9th day of September, 1915, and of record in the aforesaid Clerk’s Office in Deed Book 165 at page 327; thence easterly along the line of M.W. Hushion (formerly J.A. and T.J. Wetherell) 110 feet to a drill hole in the westerly line of a 12 feet alley; thence with the westerly line of said alley 39.8 feet to another drill hole corner to Nellie A. Couch (formerly Rowena Rauch); thence in a westerly direction with the Couch Line 110 feet to Juliana Street; thence northerly with Juliana Street 39.8 feet to the place of beginning, as more particularly set forth in that certain survey by J.V. Dunbar, C.E., bearing date the 9th day of September, 1915, and of record in the aforesaid Clerk’s Office in Deed Book 165 at page 327, and by a recent survey bearing date the 27th day of April, 1970, by Arden Marshall of record in the aforesaid Clerk’s office in Deed Book 573 at page 346 to both of which surveys reference is had and made for a more particular description of the foregoing lot.
Being the same property conveyed unto Mercature, Ltd, Inc., a corporation, from Toby Thomas, single, by deed dated September 14, 1987, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 853 at page 396.
It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.
Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.
Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.
