NOTICE OF TRUSTEEáS SALE

 

Pursuant to the authority vested in the undersigned J. Patrick Jones, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Wood West Virginia, and by Deed of Trust dated October 20, 2006, executed by James T. Willison and Rickie Susan Willison to Richard A. Pill, Trustee, which deed of trust is of record in the Office of the Clerk of Wood County, West Virginia, in Trust Deed Book 1391 at Page 831, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on November 20, 2015 at 3:00 p.m. to the highest bidder at the front door of the Courthouse of said County of Wood, in Parkersburg, West Virginia, which real estate is more completely described as follows:

 

FIRST BEGINNING on the County Road, at C W Dowling’s northwesterly corner, running thence along the said County Road, in a westerly direction, fifty (50) feet, thence through Lot No 4 in a southerly direction, two hundred and seventy-five (275) feet, more or less, to the Electric Railroad, on School street, thence in an easterly direction along the said Railroad forty-eight (48) feet to C W Dowling’s southwesterly corner, thence along the said C W Dowling’s westerly line, two hundred and seventy-five (275) feet to the place of beginning, and being parts of Lots Nos 4 and 5 in M Richter’s Addition to the Town of Williamstown.

 

SECOND BEGINNING at a point in the northerly line of the County Road, and opposite the northwestern corner of said Kerr’s Lot in M Richter’s Addition to Williamstown, West Virginia, thence in an Easterly direction with the northerly line of said road fifty (50) feet to a stake or iron pin, thence in a northerly direction and in same direction as said Kerr’s lot above mentioned, five hundred and fifty (550) feet to an iron pin at low water mark of the Ohio River, thence along the Ohio River in a Westerly direction fifty-four (54) feet to an iron pin, thence in a southerly direction five hundred and fifty (550) feet to the place of beginning.

 

This conveyance is made subject to all rights of ways for utilities and particularly to the right of way of The Baltimore & Ohio Railroad Company and to that certain right of way granted by Frank Gluff, widower, to the City of Williamstown for sanitary sewer dated the 17th day of August, 1957 of record in the aforesaid Clerk’s Office in Deed Book 414, at page 56, and that certain right of way granted by Frank Thomas Gluff, widower, to the City of Williamstown for road purposes dated the 19th day of July, 1960, of record in the aforesaid Clerk’s Office in Deed Book 448, at page 131.

 

TERMS OF SALE

 

  1. Cash in hand paid on the day of sale.

 

  1. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, right of ways and easements of any nature whatsoever.

 

  1. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code ç 11-22-2.

 

  1. The subject property will be sold in âAS ISã condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed.

 

  1. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

 

  1. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above.

 

  1. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid.

 

  1. Such other terms as may be announced at the time of Sale.
