NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated May 13, 2011, executed by Borrower(s), Jeffrey J Smith, to Samuel I. White, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1650, at Page 662. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 544 Homestead Drive, Williamstown, WV 26187. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 13, 2015, of record in the Clerk’s Office in Book 1860, Page 122. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

 

June 16th, 2016 at 5:40 P.M.

 

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Williams District, Wood County, West Virginia, and being more particularly described as follows:

 

All that certain lot, tract, or parcel of land together with the improvements thereon and the appurtenances thereunto belonging, situate in Williams District, Wood County, West Virginia, and being more particularly described as follows:

 

Beginning at a point in the southeasterly line of Homestead Drive, which said point is 750 feet (mistakenly listed as 700 feet in the last conveyance) measured along said line of said Drive from the easterly right of way line of U.S. Rt. 21 and is at the northeasterly corner of the Matheny tract; and thence with the easterly line of Matheny tract, S. 34õ W. 134 feet to a point, corner to Matheny and in the outside line of Posey; thence with the outside line of Posey in a general easterly direction 600 feet, more or less, to the Henry line; thence with the Henry line in a northerly direction 134 feet to the southwesterly line of Homestead Drive, extended; and thence with the southwesterly line of Homestead Drive in a general northerly direction 600 feet, more or less to the place of beginning.

EXCEPTING and RESERVING from this conveyance the following:

 

Beginning at a pin (found) at the northeast corner of the Brown tract Deed Book 969, at page 303, and in the south line of Homestead Drive, thence S. 56õ 00á 00ã E. 65.47 feet with the south line of Homestead Drive to a 1/2ãiron rebar (set); thence S. 04õ 01á 04ã W. 71.16 feet to a 1/2ã iron rebar (set), thence S. 36õ 28á 52ã W. 71.61 feet to a 1/2ã iron rebar (set) in the north line of Valley Manor Addition, Plat Book 15, page 20; thence N. 56õ 20á 55ã W. 97.39 feet with the north line of Valley Manor Addition to a pin (found) at the southeast corner of the said Brown tract; thence N. 33õ 46á 02ã E. 133.77 feet with the east line of Brown to the place of beginning, containing 0.281 acres.

Being the same property conveyed unto Neal A. Smith and Jodi L. Smith by Marjorie L. Kidwiller McKinney, by Deed dated July 31, 1998, and recorded in the aforesaid Clerkás Office, in Deed Book 937, at page 252.

 

TERMS OF SALE:

 

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

 

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Œ 11-22-1.

 

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

 

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

 

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

 

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
