NOTICE OF TRUSTEE’S SALE
Under and by virtue of the authority vested in the undersigned Trustee, by that certain Substitution of Trustee dated September 20, 2016, of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book 1937, at page 178, and by that certain Deed of Trust dated January 30, 2015, executed by Timothy P. Battin and Deborah S. Battin, securing First Neighborhood Bank, Inc., of record in the aforesaid Clerk’s Office in General Lien Book 1859, at page 492, and said Deed of Trust providing that the Trustee on being required so to do by the holder of the Promissory Note secured by said Deed of Trust, should sell the hereinafter described at public auction, and default having been made in the payment of the indebtedness secured thereby and having been requested so to do, the undersigned will sell at public auction on
Friday, October 21, 2016, at 10:00 o’clock a.m.,
at the front door of the Wood County Courthouse in Parkersburg, West Virginia, that certain real estate situate in the City of Parkersburg, County of Wood, and State of West Virginia, more particularly bounded and described as follows:
FIRST TRACT: Beginning at an iron rod in the westerly line of Welles Street., said point being the southeast corner of Lot No. 72 as shown on an amended plat of Highland Park Addition of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book No. 2, at page 84; thence with the northern line of Wells Circle four courses and distances which are as follows: N 61-15 W 80.00 feet to a nail set in the base of a TV tower; S 89-40 W 98.25 feet to an iron rod set: S 84-41 W 50.38 feet to an iron pipe found, S 67-59 W 95.83 feet to an iron pipe; thence N 57-00-30 W 115.77 feet to an iron pipe found in the easterly line of High Street; thence with the easterly line of High Street North 60-10 E 334.42 feet to an iron rod; thence continuing on with High Street South 61-55-30 E 126.75 feet to an iron rod set at the northwest corner of Lot No. 75 of the aforesaid addition: thence with two lines of said Lot No. 75 S 27-44 W 43.34 feet to an iron pipe found; thence S 63-02 E 80-01 feet to an iron pipe found in the westerly line of Welles Street; thence with the westerly line of Welles Street South 27-44 W 37.00 feet to an iron pipe found; thence N 61-15 W 80.00 feet to an iron rod found; thence S 27-44 W 34-40 feet to a mining bolt found; thence S 61-15 E 80.00 feet to a bolt found in a concrete walk in the westerly line of Welles Street; thence with the westerly line of Welles Street South 27-44 W 33.00 feet to the place of beginning containing 1.206 acres; being all of Lot no. 72 and part of Lot no. 74 and all of Lot âAã

SECOND TRACT: Beginning at a point in the base of a 36ã maple tree said point being in the intersection of the westerly line of Welles Street with the southern line of Welles Circle as shown on a plat of Highland Park Addition Amended Plat in Plat No. 2 of record in the aforesaid Clerkás Office in Plat Book No, 2, at page 84; thence with the westerly line of Welles Street South 27-44 W 50.00 feet to an iron rod; thence N 61-15 W 64.00 feet to an iron pipe found; thence S 27-44 W 50.00 feet to an iron rod set in the northerly line of a 15.00 foot alley; thence with the northerly line of said alley North 61-15 W 150.37 feet to a railroad spike set in the southern line of Welles Circle; thence with the southern line of Welles Circle four courses and distances as follows: N 67-59 E 47.71 feet to a railroad spike; N 84-41 E 38.01 to a railroad spike; N 89.40 E 85.79 feet to a drill hole; S 61-15 E 76.00 feet to the place ofá beginning containing 0.287 acres and being part of unnumbered lots shown on the aforesaid plat of Highland Park Addition of record in the said Clerks office in Plat Book 2, at page 84.

TERMS OF SALE: Said property will be sold for cash in hand on the day of sale, or acceptable letter of credit, by auction to the highest bidder. The sale shall be further subject to the following:
(1) Real estate taxes delinquent, due and payable or to become due and payable;
(2) Any statutory lien or liens that have priority over the subject deed of trust that may affect the property;
(3) Any and all validly existing and continuing covenants, conditions, restrictions, reservations, easements and rights-of-way of record in the chain of title to the property or affecting title to the property;
(4) Such matters as could be ascertained by a current survey or physical inspection of the property;
(5) The property will be sold AS IS, WHERE IS, in its present condition with all faults and defects, if any, and without any warranty express or implied.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale.
