NOTICE OF TRUSTEE’S SALE

 

NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described, and the undersigned having been required so to do by the owner and holder of said indebtedness, the undersigned Substitute Trustee {see General Lien Book No. 2015, at page 358 thereof} will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on

 

FRIDAY, JUNE 15, 2018,

at 10:00 o’clock in the

forenoon, local time,

 

at public auction, to the highest bidder for cash, all of the right, title and interest of NELSON C. BELL in and to the real property described in a certain deed of trust dated March 4, 2016, to PATRICK W. BRYAN, original Trustee, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book No. 1909, at page 590 thereof, possessed by the said NELSON C. BELL as at the making of said deed of trust, which real estate conveyed by said maker is described therein as follows, to-wit:

 

Situate in the District of Tygart, County of Wood, and the State of West Virginia, more particularly bounded and described as follows, to wit:

 

All that certain lot, tract or parcel of real estate located in the District of Tygart, Wood County, State of West Virginia, more particularly bounded and described as follows:

 

BEGINNING at a point in the southerly boundary of a 3.13 acre tract of which this conveyance is a part, said tract being more particularly described by a âSurvey of Part of Claradon L. Ott, et al Propertyã, by Paul K. Marshall, L.L.S., September 1, 1983, attached to the deed herein referred to and made a part hereof by reference thereto, said point being the northeast corner of a tract or parcel heretofore conveyed to the William B. Lutz and Myrtle A. Lutz, husband and wife, by a deed from Paul M. Knotts and Barbara S. Knotts, husband and wife, dated the 21st day of July 1972, and of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 602, Page 416; thence with the common line of said northwest corner of the tract or parcel last mentioned heretofore conveyed to Lutz, as aforesaid; thence N. 34 degrees 11’ W. 309 feet, more or less, to a point in the northerly line of the 3.13 acre tract aforesaid; thence N. 58 degrees 00’ E. 100 feet, more or less, to the northwest corner of a tract or parcel of land conveyed unto Donivan L. Cumpston, single; thence S. 34 degrees 11’ E. 309 feet, more or less, the place of beginning.

 

There is FURTHER GRANTED and CONVEYED herein for the purpose of ingress and egress to the property hereby conveyed, a Right of Way which is 26 feet, more or less, in width, to Route No. 21.

 

There is FURTHER GRANTED and CONVEYED a perpetual right of way and easement for all utility services which includes the installation, repair, service, maintenance and replacement thereof. Said Right of Way and easement shall be 20’ in width more or less and 200’ in length along the West boundary (N. 36 degrees 04’ W. 200 feet) of the following described lot, tract or parcel of land, and extending from Blair Avenue to said real estate, which right of way is on, over and across that certain lot, tract or parcel of land in Tygart District, County of Wood and State of West Virginia, more particularly described as follows:

 

BEGINNING at a point in the northerly line of Blair Avenue, said point being S. 56 degrees 01’ W. 200 feet from the easterly line of the Ray Ott, et al. Property; thence with said line of Blair Avenue S. 56 degrees 01’ E. 100 feet to a stake; thence South 36 degrees 04’ E. 200 feet to the place of beginning, containing 0.458 acres.

 

Should this conveyance of the above particular description, for any reason, prove incorrect or inadequate to cover the property intended to be conveyed as specified, the Party of the First Part, their heirs, successors beneficiaries or assigns, agree to execute any instrument or instruments as may be necessary to correctly or properly transfer the property intended to be conveyed as specified or to correct the particular description.

 

This conveyance is made subject to all easements, rights of way, restrictions, reservations and protective covenants, including but not limited to all oil, gas and mineral exceptions, reservations and leases, appearing in the chain of title.

 

Upon information and belief, the Real Property or its address is commonly known as

 

102 Left Grove Avenue, Parkersburg, West Virginia 26101.

 

Upon the following terms to-wit:

 

  1. Cash in hand on day of sale, or as the Trustee may otherwise agree.
  2. Minimum acceptable bid is $68,000.00, of which the sum of $5,000.00 by Bank or Cashier’s check must be delivered at the sale.
  3. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantor and her predecessors in title prior to the granting of the deed of trust being foreclosed upon.
  4. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned.
  5. The undersigned reserves the right to reject any and all bids.
  6. Sale is subject to unpaid ad valorem taxes and special assessments, if any, as well as any sale of the subject real estate for unpaid taxes.
  7. The premises described hereinabove, including any and all improvements thereto, are sold âAS IS-WHERE ISã with no warranty express or implied.
  8. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale.
  9. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed.
  10. Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the successor trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property.
  11. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim.
  12. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control.
  13. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.
