NOTICE OF TRUSTEE’S SALE

 

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated February 23, 2006, executed by Borrower, Seymore A Deem Jr, to Tommy Dixon, the Trustee of record in the office of the Clerk of the County Commission of Wood County, West Virginia, in Book 1342, at Page 680 and re-recorded on November 22, 2006 in Deed of Trust Book 1398 at Page 81.  At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 709 Hall Street, Parkersburg, WV 26101.  WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 5, 2018, of record in the Clerk’s Office in Book 2044, Page 88.  The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust.  Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Wood County, in Parkersburg, West Virginia, on the following date:

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in City District, Wood County, West Virginia, and being more particularly described as follows:

 

Tract 1

BEGINNING at a point in the northerly line of Hall Avenue, which said point is a distance of 404.10 feet from the Northeast corner of the intersection of Hall Avenue and Seventh Avenue; thence N. 34 deg. 30áE. 130 feet to a point; thence in a Southeasterly direction and parallel with Hall Avenue, 50 feet to a point in the Westerly line of Lot No. 7 of Halls Addition No. 3, thence S. 34 deg. 30á W. 130 feet to the Northerly line of Hall Avenue; thence with the Northeasterly line of Hall Avenue, 50 feet to the place of beginning. Being a part of Lot No 6 of the above named Addition. Being the same property conveyed by Steven M. VanClief, el al. to Brenda S Lipler, by deed dated the 5th day of June, 1995 and recorded in the Office of the Clerk of Wood County in Dead Book 944 at page 102.

This property is made subject to the right of way conveyed by Brenda S. Deem to the City of Parkersburg by Deed dated May 15, 2002, and of record on the Office of the Clerk of the County Commission of Wood County in West Virginia in Deed Book 1040, at page 587.

BEGINNING at a point in the northeasterly lines of Hall Avenue, said point being 454.1 feet in a southeasterly direction from the intersection of Seventh and Hall Avenues, thence at right angles and in a northeasterly direction 169.72 feet to a point; thence S 42 degrees 54’ E 51.23 feet to a point; thence S 34 degrees 30’ W. 158.54 feet to a point in the northeasterly line of Hall Avenue; thence N. 55 degrees 50á W. 50 feet to the place of the beginning. being all of Lot No. Seven (7) as shown on a plat of Hall’s Addition No 3, which is recorded in the aforesaid Clerkás Office in Plat Book No. 8. at page 77 Being the same property conveyed by Roger D. McGee to Brenda S. Deem, by deed dated the 21st day of September, 2000 and recorded in the Office of the Clerk of Wood County in Deed Hook 1018 at page 203.

 

Tract 3

BEGINNING at a ½ã rebar set, corner to Justin Thomas, thence crossing parent tract, South 35 degrees 59 minutes East, a distance of 51.21 feet to a ½ã rebar set, corner to Roger McGee, thence with McGee, South 41 degrees 34 minutes West, a distance of 39.80 feet to a point, corner to Brenda Epler: thence with Epler, North 48 degrees 23 minutes West, a distance of 50.00 feet to a point in the line of Thomas, thence with Thomas, North 41 degrees 34 minutes East, a distance of 50.80 feet to the place of beginning, containing 2265 square feet, more or less, more fully described on a plat prepared by Board Land Surveying. Being the same property conveyed by Carol M. HoIbert, et ux. to Brenda Deem, by deed dated the 9th day of November, 1999 and recorded in the Office of the Clerk of Wood County in Deed Book 1010 at page 822.

This property is made subject to the right of way conveyed by Brenda S. Deem in the City of Parkersburg by Deed dated May 15, 2002, and of record in the Office of the Clerk of the County Commission of Wood County in West Virginia in Deed Book 1040, at page 584.

 

Being the same property conveyed to Seymore A Deem Jr by the Deed dated December 31, 2002 and recorded in Deed Book 1048 at Page 758 in the Office of the Clerk of the County Commission of Wood County, West Virginia.

 

 

TERMS OF SALE:

 

1) The property will be conveyed in an âAS ISã physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerkás office or affecting the subject property.

 

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Π11-22-1.

 

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

 

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

 

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

 

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
