NOTICE OF TRUSTEE’S SALE
TO: Chad Allen Moore and David A. Masters, also known as David Allen Masters
Notice is hereby given that on October 4th, 2019, at 9:30 a.m., at the front doors of the Marion County Courthouse in Fairmont, West Virginia, Jeffery S. Compton, Trustee, will sell at public auction the real estate reported to have a mailing address of 2662 Colfax Road, Fairmont, WV 26554, formerly known as Rt. 4 Box 381, (“the Real Estate”), and described below, pursuant to the authority granted by the following instrument:
(1) that certain Deed of Trust (“the Deed of Trust”) executed by Martha L. Ingram and David Allen Masters (“the Grantors”) to Jeffery S. Compton, Trustee, for the therein named lender, bearing the date of July 23, 2012, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Trust Deed Book 1034, at Page 505.
As the Grantors of the Deed of Trust have defaulted in the payment of the indebtedness secured by the Deed of Trust, the lender therein, the owner and holder of the note evidencing such indebtedness, has formally instructed the undersigned Trustee to advertise and sell the Property, on the terms and conditions more particularly set forth in the Deed of Trust. Therefore, I, Jeffery S. Compton, the undersigned Trustee, will sell to the highest bidder, the Real Estate as conveyed to the beneficial holder of the Deed of Trust and described as follows:
That certain lot situated on the waters of Guiser’s Run, in Union District, Marion County, West Virginia, more particularly described as follows:
TRACT ONE: Beginning at a point in the right of way of County Road and corner now or formerly to Chas. Miller and running thence with his line, S. 20 1/2° E. a distance of 430.1 feet to a post corner to other lands now or formerly of F.L. Balderson; thence with two lines now or formerly of said F.L. Balderson, S. 69 1/4° W. a distance of 100.0 feet to a stake; thence N. 20° 40’ W. a distance of 439.2 feet to a point in the right of way of the County Road; thence with said right of way line, N. 74 3/4° E. a distance of 105.4 feet to the place of beginning, containing 1.02 acres, more or less.
TRACT TWO: Beginning at a stake in the right of way of County Road and corner formerly of Walter L. Balderson and running thence with his former line, S. 20 3/4° E. a distance of 439.2 feet to a stake corner to lands now or formerly of F.L. Balderson; thence S. 69° 15’ W. a distance of 100.0 feet to a corner; thence N. 20° 45’ W. a distance of 448.0 feet to a point in the right of way of the County Road; thence with said right of way line, N. 74° 45’ E. a distance of 100.0 feet to the place of beginning, containing 1.02 acres, more or less.
TRACT THREE: Beginning at an iron pin in the southern right of way of WV Route 66 (Colfax Road), at a point common to lands now or formerly of Minnie J. Balderson, which lands are described as Parcel Number 3 in that certain deed dated November 14, 1984, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 856, at Page 1117; thence with the western line of said Parcel Number 3, S. 20° 45’ E. a distance of 143.5 feet to a point in the bank of Guiser’s Run; thence with said run, S. 72° 54’ 49” W. a distance of 85.24 feet to a point; thence N. 13° 29’ 55” W. a distance of 157.49 feet to an iron pin in said right of way of WV Route 66 (Colfax Road); thence with said Road, N. 84° 27’ 37” E. a distance of 67.56 feet to the place of beginning, containing .2614 acres, more or less.
Being all the same lands conveyed to Martha L. Ingram, by deed dated the 14th day of February, 2008, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1032, Page 278. Thereafter, the said Martha L. Ingram died testate on the 28th day of January, 2016, and by the terms of her Last Will and Testament, of record in the aforesaid Clerk’s Office, in Will Book 147, at Page 213, she devised the above described real estate to Chad Allen Moore and a life estate interest in and to the above described real estate to David A. Masters, also known as David Allen Masters.
This conveyance is made subject to any and all existing reservations, restrictions, rights-of-way and conditions as are contained in the chain of title to said property.
This sale will be made subject to any persons in possession and the rights of any tenants therein, and the Real Estate will be sold “as is” and “where as,” without any representation or warranty, express or implied, as to the condition of the improvements, the availability of utilities, the existence of latent or patent defects, the existence of any defect affecting the quality or marketability of the title thereof, and matters which would be revealed by an accurate survey or visual inspection of the premises, the improvements thereon and its boundaries.
TERMS OF SALE: The Real Estate will be sold for cash in hand on day of sale. All those intending to be present and bid at the time and place of sale must register with a valid proof of identity, an original, valid and enforceable letter of credit, in executed form, setting forth a certification of immediately available “good funds,” the bank or source of the same, in amounts equivalent to any proposed bid, all being subject to Trustee or secured principal party approval. All bids may be freely assigned to qualified parties or entities. Purchaser is liable for all taxes due on the real estate. Purchaser shall pay all fees for transfer tax stamps, advertising and recording costs incurred pursuant to said bid, purchase and transfer. The undersigned Trustee reserves the right to continue this sale from time to time and to reject any and all bids or offers.
FEDERAL TAX LIEN NOTICE: In the event that there are Federal Tax Liens against the property, the United States of America would have the right to redeem the property within a period of one hundred and twenty (120) days from the date of said sale, or the period allowable for redemption under local law, whichever is longer.
