NOTICE OF TRUSTEE’S SALE


To: Stephen E. Jurasko and Michelle Jurasko
Notice is hereby given that pursuant to the authority of that certain Deed of Trust executed by Stephen E. Jurasko and Michelle Jurasko, to the Trustee as therein named for said Lender, said Deed of Trust bearing date of the 9th day of June, 2006, and of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Trust Deed Book No. 866, at Page 90, and default having been made in the payment of the indebtedness secured by the aforesaid Deed of Trust, and further, said Lender having executed that certain Appointment of Substitute Trustee appointing and substituting Keith J. Pappas as the Trustee of the aforereferenced Deed of Trust instrument, and that the said Trustee has been formally instructed by said Lender, the owner and holder of the Note evidencing said indebtedness, to advertise and sell the property as hereinafter described, on the terms and provisions as more particularly set forth in said Deed of Trust. Therefore, I, Keith J. Pappas, the undersigned Trustee, will on Friday, the 14th day of February, 2020, at 11:00 a.m., offer for public sale to the highest bidder, for cash, at the main entrance of the Marion County Courthouse, situate at 219 Adams Street, Fairmont, West Virginia, the real estate as conveyed by said Deed of Trust and therein described as follows, to wit:
All that certain lot or parcel of real estate, together with the buildings and improvements thereon and the appurtenances thereunto belonging, situate, lying and being in Union District, Marion County, West Virginia, with a known address of 35 Konnor Lane, Fairmont, WV, more particularly bounded and described as follows, to-wit:
Beginning at an iron rod, corner to Marshall and other lands of Grantors, and running thence with other lands of Grantors, N. 88° 50′ 27″ W. 189.34 feet to an iron rod; thence with three arbitrary lines through Grantors’ land, N. 12° 59′ 26” E. 195.63 feet to an iron rod; S. 73° 35′ 30″ E. 298.25 feet to an iron rod; and S. 51º 56′ 44″ W. 178.78 feet to the place of beginning, containing 0.91 of an acre, more or less.
There is further granted and conveyed a right of way over other lands of the grantors, for ingress, egress, and access, running from the parcel herein conveyed to an existing 16.5 foot right of way, which right of way hereby conveyed is described as follows:
Beginning at an iron rod, corner to Marshall, and being the southernmost corner of the real estate hereby conveyed, and running thence with Marshall, S. 6º 43′ 20″ W. 35.88 feet to a point on the southern edge of an existing 12 foot right of way, which point bears N. 6° 43′ 20″ E. 114.97 feet from an iron rod in the corner of Jurasko and Marshall; thence S. 85° 55′ 32″ W. 112.75 feet; N. 89° 22′ 25″ W. 123.69 feet; S. 80° 02′ W. 121.32 feet; thence S. 72° 42′ 12″ W. 139.70 feet to a point on the northern edge of an existing 16.5 foot right of way in line of land now or formerly owned by Anthony Paul; thence with line of the existing 16.5 foot right of way, N. 84° 35′ 46″ W. 31.09 feet; thence back through Grantors’ lands, N. 72° 42′ 12″ E. 169.16 feet; N. 80° 02′ E. 123.20 feet; S. 89° 22′ 25″ E. 124.31 feet; N. 85° 55′ 32″ E. 84.01 feet; thence leaving the existing 12 foot right of way, N. 6° 43′ 20” E. 26.46 feet in line of the real estate hereby conveyed, and thence with said real estate, S. 88° 50′ 27” E. 30.14 feet to the place of beginning, said right of way containing 0.16 of an acre.
And being all the same real estate conveyed to Stephen Eric Jurasko and Michelle L. Jurasko from Michael David Jurasko and Elda Colleen Jurasko by deed dated the 28th day of February, 2006, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 1009, at Page 1016.
This property will be conveyed subject to the exceptions, reservations, rights of way, condition, and restrictions of record, affecting said real estate.

THIS SALE is made subject to any prior liens, assessments or mortgages, persons in possession and the rights of any tenants therein and said property is being sold “as is,” and “where as,” without any representation or warranty, express or implied, as to the condition of the improvements, the availability of utilities, whether latent or patent defects may exist therein or thereon, the existence of any defect respecting the quality or marketability of the title thereof, matters which would be revealed by an accurate survey or visual inspection of the premises, the improvements thereon and its boundaries.
