NOTICE OF TRUSTEE’S SALE
Take notice that on the 10th day of March, 2020, at 10:00 a.m.,at the front entrance of the Marion County Courthouse, Fairmont, West Virginia, the undersigned Trustee will sell at public auction to the highest bidder the real estate hereinafter described pursuant to that certain deed of trust dated May 10, 2013, executed by Crystal L. Sloan to James C. Gardill, Trustee, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Trust Deed Book No. 1056, at page 776, default having been made therein, the following described lots or parcels of real estate situate in the City of Fairmont, Union District, Marion County, West Virginia, described as follows:
LOT NUMBER FOUR (4) OF THE O. J. FLEMING SUBDIVISION OF BLOCK NUMBER THREE (3) OF THE COOGLE ADDITION TO THE EAST PART ADDITION,as more particularly shown upon a map or plat of the same which is of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 231,at page 346, and also shown on a map or plat of record in the said Clerk’s Office in Deed Book No. 812, at page 130.
The above real estate hereby conveyed is the same real estate conveyed to Charles L. Sloan and Myrtle B. Sloan, husband and wife, as joint tenants with right of survivorship, by Robert G. Messenger and Betty Jo Messenger, husband and wife, by deed dated June 16, 1978, of record in the said Clerk’s Office in Deed Book No. 812, at page 126. Myrtle B. Sloan died June 10, 2009, thereby vesting ownership of said real estate in Charles L. Sloan. By deed dated June 21, 2011,of record in said Clerk’s Office, Charles L. Sloan conveyed an interest in said real estate to Crystal L. Sloan, thereby creating a joint tenancy with right of survivorship between them. Charles L. Sloan died February 21, 2012, leaving Crystal L. Sloan as sole owner of said real estate.
Conveyance of said real estate is subject to the exceptions, reservations, restrictions, conditions, easements, and rights of way contained in prior deeds of record in the chain of title to said real estate.
Conveyance of said real estate is subject to all unpaid property taxes, if any, on said real estate.
The above described real estate has an address of 410 KENTUCKY A VENUE, FAIRMONT, WEST VIRGINIA 26554.
The property will be conveyed in an “as is” physical condition, without warranty as to habitability or fitness.
The trustee reserves the right to continue the sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the trustee.
By written designation and substitution of trustee dated June 18, 2019, of record in said Clerk’s Office, J. Scott Tharp was designated as Substitute Trustee under said deed of trust.
The total purchase price is payable to the Trustee by cashier’s check, cash, or the equivalent within 20 days of the date of sale, with ten percent (10%) of the total purchase price payable to the Trustee at sale by cashier’s check, cash, or the equivalent.
