PERSONAL PROPERTY

 

NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described and the undersigned having been required so to do by the owner and holder of said indebtedness, the undersigned Substitute Trustee {see Lien Book No. 1896, at page 293 thereof} will offer for sale at the front door of the Wood County Courthouse, Parkersburg, West Virginia, on

 

Friday, January 8, 2016,

at 9:30 o’clock in the forenoon, local time,

 

at public auction, to the highest bidder for cash, all of the right, title and interest of JEFFERY L. SCHMITT, JR., and JAMIE L. SCHMITT in and to the real property described in a certain deed of trust dated May 5, 2006, to P. MICHAEL PLESKA and F. T. GRAFF, JR., original Trustees, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in General Lien Book No. 1356, at page 247 thereof, possessed by the said JEFFERY L. SCHMITT, JR. and JAMIE L. SCHMITT as at the making of said deed of trust, which said real estate is described in said deed of trust as follows:

 

Real Estate lying and being in the District of Slate, County of Wood, and State of West Virginia, and more particularly described as follows:

 

FIRST TRACT: BEGINNING at a nail in the center of the Sugar Camp Run Road; thence with the center of said road N. 21 deg. 04’ E. 59.5 feet to a nail; thence S. 79 deg. 30’ E. 26.10 feet to an iron pin in line of Paul R. Lemon; thence with his line S. 27 deg. 39’ E. 34.7 feet to a stone monument; thence S. 71 deg. 50’ W. 66 feet to the place of beginning, containing 0.05 acre, as shown by survey made September 6, 1973, by Arden Marshall, a copy filed with a previous Deed in Deed Book 635, at page 415.

 

SECOND TRACT: BEGINNING at a nail in the center of Sugar Camp Run Road, being the northwesterly corner of a tract containing 5.05 acres, more or less, of which this is a part; thence N. 71 deg 50’ E. 66 feet (North 72 deg. East 66 feet in a prior Deed) to a stone; thence with Paul R. Lemon tract, S. 27 deg. 25’ E. (South 27 deg. 30’ East in a prior Deed), 254.32 feet to a point; thence S. 49 deg. 12’ W. 61.5 feet to a one-half inch pipe; thence N. 64 deg. 37’ W. 237.99 feet to a nail in the center of said Sugar Camp Run Road; thence with the center of said Sugar Camp Run Road; thence with the center of said roadway N. 18 deg. 56’ E. 68 feet (North 16 deg. East in a prior Deed), to a nail; thence N. 37 deg. 04’ E. 99 feet (North 30 deg. 10’ East in a prior Deed) to a nail, the place of beginning, containing 0.86 acre, more or less, as shown by Plat made by Paul E. Marshall, County Surveyor, on May 3, 1977, recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 686, at page 656.

 

Being the same real estate conveyed unto Jeffery L. Schmitt, Jr., by Deed from Belinda J. Raines, single, dated February 8, 2005, and recorded in the aforesaid Clerk’s Office in Deed Book 1079, at page 11.

 

This conveyance is made SUBJECT to all restrictions, reservations, rights of way and exceptions, as set forth in prior deeds in the chain of title, as well as to all oil, gas and other mineral reservations, made by predecessors in the chain of title, and to all valid and existing rights of way and easements necessary or incident to remove and develop the same,

 

AND believed to be located on Sugar Camp Run Road, Mineral Wells, West Virginia.

 

There is present on said real estate a certain 2005 Dutch DT-286403W unit of manufactured housing, serial number DHIN44129E, and the undersigned, as agent of the secured party, United Bank, Inc., will offer said unit of manufactured housing for sale at public auction at the time, place and date set forth above and under the same terms and conditions.

 

The following terms will apply to said sale, to-wit:

 

  1. $5,000.00 in cash or certified funds at sale, with balance due within 10 days or as the Trustee and bidder(s) may otherwise agree at sale.

 

  1. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantors and their predecessors in title prior to the granting of the deed of trust being foreclosed upon.

 

  1. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned.

 

  1. The undersigned reserves the right to reject any and all bids.

 

  1. Sale is subject to unpaid ad valorem taxes and special assessments, if any.

 

  1. The premises and the unit of manufactured housing described hereinabove, including any and all improvements thereto, are sold âAS IS-WHERE ISã with no warranty express or implied.

 

  1. The owner and holder of the indebtedness secured by the deed of trust described hereinabove reserves the right to bid at this sale.

 

  1. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed.

 

  1. Neither the owner and holder of the indebtedness secured by the underlying deed of trust nor the substitute trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property.

 

  1. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion. Any person or entity claiming ownership of or any interest in any such property should contact the undersigned prior to sale about any such claim.

 

  1. The successful bidder at the sale and the Trustee shall execute a Memorandum of Sale at the conclusion of the sale, and the terms of the Memorandum shall control.

 

  1. In the event that the successful bidder at the sale fails or refuses to consummate his, her, its or their purchase, then the Trustee shall have the option to consummate sale with the next highest bidder at the sale.
